Land Grab Case: Pre-arrest bail denied, Court directs custodial interrogation

Kathua, Sept 13(JNF): Principal Sessions Judge Kathua MK Hanjura in a significant order has rejected the pre-arrest bail of old lady namely Indra Devi w/o Lt. Bhagat Ram r/o Raj Bagh Tehsil Hiranagar who was allegedly involved in impersonation and land-grabbing.
While rejecting the bail, Court referred the police report in which it was stated that the accused namely Indra Devi, Daljeet Singh, Surjeet Singh, HN Gupta Advocate, Sat Pal and Khajur Singh hatched a criminal conspiracy to fabricate a false document with the intention to cause injury to the complainant Soma Devi. In furtherance of this conspiracy Indra Devi presented a Special Power of Attorney executed in favour of Surjeet Singh for registration before the then Sub-Registrar Hira Nagar in respect of land bearing survey No 422/1 measuring 2 Kanals situated at Village Muthi Hardo, Raj-Bagh Tehsil Hira Nagar by falsely personating the actual executant.
While rejecting the pre-arrest bail Principal Sessions Judge Kathua MK Hanjura after hearing Adv Sat Pal for the petitioner and Public Prosecutor Ravi Kumar Gupta for state, observed that land grabbing is a new master crime. Any organized group can and does indulge in this most sophisticated of undetected Art and Craft of the Crime of Land Grabbing. The Big-Sharks of the society use all the weapons of cunning silence and duplicity. In this case the accused in furtherance of a conspiracy are alleged to have fabricated a false document with the intention to deprive an innocent land of her land to the tune of 2 Kanals. This appears to be a case of land grabbing by using the weapons of cunning silence. Merely because the petitioner/accused is a woman will not clothe her with the right to claim pre-arrest bail where the magnitude of the alleged crime is alarming. Therefore, custodial interrogation of the accused is warranted in the instant case as the investigating officer has been specific in stating that investigation of the case is still in progress.
