Court denies bail to self-styled DFO | Fake appointment racket | | early times report Jammu, Sept 13 (JNF): Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal today rejected the bail application of a self-styled DFO namely Mohd Yousaf Wani s/o Abdul Ahad Wani r/o Kunzar, Tangmarg who was allegedly involved in making fake appointments and collected heavy amounts from the complainant and her relatives. According to the police case, the complaint on behalf of Sikander Hayat. Sikander Hussain, Mushtaq Hussain, Mohd Aksar, Mohd Azam and Mohd Alyas duly endorsed by Special Municipal Magistrate, Jammu received in the Crime Branch wherein it had been alleged that on 19.5.2010 the complainants came to Jammu and from some independent source, came to know about the religious activities of one Mohd Ashraf Peer who was residing in the house of Mamta Devi Akalpur, Jammu. The complainants met with the said Peer and narrated their miseries to him on which they were told by the said Peer that the Mamta Devi, her husband Jasbir Singh, daughter Sonia and Neelam Devi W/O Harnam Singh, having political links were in a position to manage government job for the complainants. On this, the complainants met with the above named persons, who assured that they would provide permanent jobs to the complainants in Social Forestry Department in lieu of Rs. 3.00 lakh each for miscellaneous expenses. The day of payment was fixed and on that day the accused persons handed over the appointment orders to the complainants pertaining to Social Forestry Department as Plantation Watcher. The accused persons also got published the select list in the newspaper and in another FIR that the complainant Mamta Devi lodged a written report against the petitioner Mohd Yousuf Wani, self styled DFO, two other accused Mohd Qayoom Master and Manzoor Qadri, self styled Municipality Clerk and self styled DFO respectively and three notorious persons to the police stating therein that she is a pious lady and dozens of people visit her residence for fulfillment of their dreams and necessities of their life. Some of the people got respite and their dreams were fulfilled and requirements were also met immediately after consulting her. She maintained a list of those visitors who have paid lucrative amounts to the above noted notorious persons. On the basis of this report, the police registered the case U/Ss 420/467/468 RPC and commenced the investigation thereupon. Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal observed it will not be appropriate to interfere and grant bail to the petitioner/accused where he has duped lot of people and has issued forged engagement orders of Plantation Watchers in Social Forestry Department. The petitioner as a matter of right is not entitled to bail. The petitioner in case is released on bail, there is likelihood that he will interfere in the normal conduct of the investigation and exposure of bigger racket being exploded will also be diluted. There is apprehension and possibility that the petitioner will not turn to the investigation/trial in case the bail is granted to him. With these observations Court rejected the bail application. |
