Ramban, Sept 29 (JNF): Principal Sessions Judge Ramban MA Chowdhary today awarded life imprisonment to three accused, Gian Singh s/o Ishar Dass Thakur, Jasbir Singh s/o Gian Singh Thakur both residents of Phalti Mitra Tehsil Ramban and Kasturi Lal s/o Ishar Dass Thakur r/o Village Kanga Tehsil Ramban who were facing trial in murder case for the last eight years.
On September 19, 2004 a written report filed by Daleep Singh s/o Dharam Chand r/o Phalti Mitra Tehsil Ramban accompanied by others alleging therein that on September 18, 2004 his brother Bir Singh alias Munna was called from his house by Gian Singh and took him to market; that he did not return late night and at the mid-night his other brother Chain Singh came to his house and told that Gian Singh had accused Bir Singh of stealing Rs 2300/- and had taken him to his house where Jasbir Singh and Kasturi Lal were also present who had confined him in a room and were investigating the theft; that Bir Singh did not confess to theft and all the three took him out of room and after tying with a rope he was assaulted by Gian Singh with a sitick and Jasbir Singh with a Spade on his head and other delicate parts with an intention to kill him as a result of which he was grievously injured resulting into his death. Police registered a case and after completion of investigation presented challan in the Court of law.
After hearing Public Prosecutor GN Manhas for the state and Advocate Aasif Hamid for the accused, the court observed that the whole case it transpires that the case was registered in the year 2004, accused were charge-sheeted in the year 2005 and the judgment convicting the accused was pronounced in the year 2012. The convicts this faced trial in this case for the last more than seven years and the case have been delayed with regard to the Trial and disposal. The convicts have faced trial as under trial prisoners throughout. Having due regard to the facts and circumstances of the case, Court is of the considered opinion that interest of the justice shall be served with a sentence of life-imprisonment and fine Rs 10,000 u/s 302 r/w 34 RPC and rigorous imprisonment for a period of three years and fine Rs 1000/- for the commission of offence punishable u/s 348 RPC. Court clarified that all the sentences shall run concurrently.
