| Court rejects bail applications of three involved in abduction | | | Early Times Report
Jammu, Oct 20: Principal Sessions Judge Kathua MK Hanjura today rejected the revision petition filed by Nar Singh & Swarn Singh both are real brother and Mohan Singh all residents of Hiranagar who are involved in abduction of complainant from Srinagar to Jammu and kept him and confined him in their rice mill. While rejecting the bail applications, Principal Sessions Judge Kathua MK Hanjura after hearing LN Sangra appearing for the petitioners/ accused whereas Public Prosecutor Ravi Kumar Gupta for the state observed that a revision filed against the order dated October 15, 2012 of the Judicial Magistrate Hiranagar whereby she has declined to grant bail in favour of the three petitioners for offences u/s 364/342/34 RPC. Against that order the petitioners/accused filed this revision in this Court for grant of bail. The petitioners in present case have allegedly abducted the complainant from Srinagarand confined him in the rice mill and beat him. Elaborate documents is not required in the bail petitions, however, but requires to be stated is that justice will be served and not thwarted or defeated in case the prayer of the petitioners for grant of bail is declined at this stage when the investigation of the case has not been concluded as has been held by the trial Court in the impugned order. With these observations Court dismissed the revision petition with the direction that petitioners shall, however, be at liberty to file a fresh application before the Court of Judicial Magistrate Hiranagar for grant of bail. According to police case that on October 8, 2012, the petitioners visited the shop of complainant situated at Pandrathan Srinagar in a white bolero and had tea with the complainant. Thereafter they said him to accompany them up to Pampore. He boarded the Vehicle, when they crossed Pampore, complainant asked them where do they attend to take him. At the moment Nar Singh closed his mouth and Swarn Singh started beating him, the driver Mohan Singh snatched his mobile. They told him that they are going to take him to Jammu and in case he does not pay money, they will kill him. They brought complainant to Jammu on October 9, 2012, they confined him in their Rice Mill and beat him. The complainant succeeded in giving them a slip and fled away and lodged a report at P/S Chadwal. A case u/s 364/342/34 RPC was registered against the persons and were arrested by the police. |
