JAMMU, Nov 16 (JNF) : Principal Sessions Judge Poonch Kishore Kumar today awarded life-imprisonment to Abdul Hamied S/O Said Mohd R/O Kasblari Tehsil Mendhar District Poonch a close associate of LeT in murder case and issued General Arrest Warrants against Asaf son of unknown and Manzoor, residents of Pakistan . According to the police case that on August 9, 2003 complainant in an injured condition presented a written application before SHO Police Station Mendhar,interalia alleging therein that he is the resident of Village Kasblari and the accused No.1 namely Abdul Hamied is also a resident of the same area who is a close associate of militants. Last night, his brother Shahmim Ahmed who was serving in Army ,had came to his residence on leave.His brother ,father along with the family members were present in the residential house and on the intervening night of 8th and 9th of August 2003 at 12 PM in the night, he heard some body knock the door and on opening the door,accused alongwith three militants namely Manzoor and Asaf and third one is unknown ,entered the house alongwith weapons and started beating him and he saved his life by running away from the spot and the militants started indiscriminate firing upon his brother and father and killed them on the spot. Upon the receipt of the this application ,Police agency of Police Station Mendhar , registered a case FIR No. 109/03 for the commission of offence U/Ss 302/123/121/122//120-B RPC and 7/25/26/27 A.Act against the accused persons and started the investigation of the case. The accused confessed his crime and on his disclosure statement one AK 47 Rifle ,2 hand grenade ,40 rounds of AK 47 and two magazines,which had been kept by him in a bag , beneath a stone, were seized .And the investigation of the FIR was culminated in the presentation of the challan in the court. Principal Sessions Judge Poonch Kishore Kumar observed that life term would commensurate with the level of the guilt and gravity of offence proved against the accused person" and awarded rigorous imprisonment for life and a fine of Rs. 25000/- for the commission of offence U/S 302 RPC and 7 years rigorous imprisonment for the offence 7/25 I.A.Act. All the sentences shall run concurrently. In case of default of fine the accused shall have further to undergo imprisonment for 6 months.
