| 3 of a family get lifer for murder | | | Jammu, Dec 4 (JNF): Principal Sessions Judge Poonch Kishore Kumar today awarded life-imprisonment to Balbir Singh S/O Darshan Singh, Ranjit Kour W/O Darshan Singh and Parvinder Kour for committing murder of Harbhajan Kour by pouring kerosene oil on her and setting her ablaze. On January 6, 2007 Mohd Hayat ASI submitted a statement of the deceased, Harbhajan Kour W/O Gurdev Singh R/O Mohalla Dungus Poonch, who was admitted in burn unit at GMC Jammu dated 03.01.2007 before police station Poonch, which reads that she was married about 6 years ago with Gurdev Singh, who is serving in police deptt. It is on 31.12.2006 that she was preparing the meal in the evening and her husband at about 7.15 P.M came to the house and asked for meal. She served the meal to him and children were also present in the room. Her husband asked her to serve the meal to the children also . On her reply that she is still serving the meal to him and she will serve to the children after the preparation of the meal. She was cooking the chapattis. Her husband became furious and left the room without taking meal. In the mean time Balbir Singh Brother in law of the deceased, who was present on the upper storey in the verandah said that they will settle the issue between them once for all by killing her. He came out from the verandah and the deceased also came out from the room. She was dragged to the room by her brother in law and in the mean while her mother in law namely Ranjeet Kour and Sister in law Parvinder Kour reached on spot and started abusing her. Her mother in law picked up a gallon of kerosene oil from the room and sprinkled upon her and her sister in law put her on fire by igniting the match box and set her to fire. The victim tried her level best to get rid of the fire flames and after a great struggle she saved herself from the clutches of the accused persons and came out of the room and raised an alarm for help. Due to this fire her body has received serious burn injuries. On the production of this statement an FIR No. 3/07 for the commission of offence U/S 307/34 RPC was registered and investigation was handed over to Mohd Hayat ASI, who commenced the investigation. He went on spot and seized one plastic gallon having some kerosene oil, one match box. He also got the photography of the place of occurrence from crime branch, half burnt and melted garments of the victim were also taken into custody from the court yard of the house of accused Ranjit Kour. The statement of the injured, under treatment at GMC Jammu was recorded by the I.O. who died on 15.01.2007. On the death of the victim, offence u/s 307 RPC was converted to 302 RPC. after completion of investigation, police presented challan against accused persons. The court after hearing Public Prosecutor Nazir Hussain for the state whereas Advocates Mahroof Manhas and Dheeraj Kour for the accused persons The mitigating facts of the case are that there is no previous conviction against the accused and this case does not fall in the category of rarest of the rare cases. Court have no hesitation to say that the offence committed by the accused persons and does not fall within the ambit of rarest of the rare cases for imposing death sentence. In my opinion life term would commensurate with the level of the guilt and gravity of offence proved against the accused persons and Accordingly accused persons namely 1.Balbir Singh S/O Darshan Singh, 2.Ranjit Kour W/O Darshan Singh and 3.Parvinder Kour D/O Darshan Singh, all residents of Dungus Ward No. 5, Poonch are awarded imprisonment for life for the commission of offence u/s 302/34 RPC. Accused Balbir Singh will serve rigorous imprisonment for life whereas Ranjit Kour and Parvinder Kour shall undergo simple imprisonment for life which ordinarily means till natural death. |
