| Accused acquitted as prosecution fails | | Abetment to suicide | |
early times report Jammu, Dec 10 (JNF): Principal Sessions Judge Samba Kartar Singh acquitted one Jagbir Singh who was facing trial in abetment to suicide case for the last 10 years, as prosecution miserably failed to prove its case. According to police case, on August 8, 2002 the complainant Swaran Singh lodged a written report in the Police Station Ramgarh stating therein that his daughter Kamlesh Kumari was married to Ranjit Singh S/o Nath Ram about two years back. Her in-laws tortured her and asked her to bring Rs. 50,000/- from her father. On 7.8.2002 deceased's father received a telephone call that his daughter had become ill and was admitted in Ramgarh hospital. When he reached Ramgarh hospital, an employee of the Hospital told him that girl had died and she was taken back to Chak Salarian. His daughter died because of torture meted out to her by her husband and brother-in-law Jagbir Singh. On the report of the complainant, a case for the commission of offence falling under section 306 RPC was registered against the accused Ranjit Singh and Jagbir Singh and investigation ensued and as a finale to it, the accused were challaned in the court of Additional Judicial Magistrate Ist Class, Samba for the commission of offence falling under section 306 RPC who made the present committal ultimately. Principal Sessions Judge Samba Mr. Kartar Singh observed that different people behave differently in a same situation. It is unfortunate that such an episode of suicide had taken place in the family but it cannot be said that the accused is in any way connected with that unfortunate act. Court further said that prosecution has miserably failed to prove its case against the accused beyond reasonable shadow of doubt. The main accused has already died in this case and the accused Jagbir Singh has not been connected with the alleged offence in any manner. He is, therefore, acquitted of the charge framed against him.
