Court awards life-imprisonment to four brothers for murdering cop

Jammu, Dec 27 (JNF) : Principal Sessions Judge Poonch Kishore Kumar today awarded life-imprisonment and fine of Rs 20,000 each to Ravinder Singh, Balraj Singh, Sukhchain Singh and Goj-inder Singh Sons of Dewan Singh R/O Mohalla Kamakhan, Ward No. 7, Poonch for committing murder of one Ranjit Singh.
According to the police on April 18, 2007 the complainant namely Har Paul Singh lodged a verbal report in the Police Station Poonch alleging therein that in the evening he got an information at his house that his brother Inderjeet Singh was attacked by Balraj Singh ,Gojinder Paul Singh, Sukhchain Singh and Ravinder Singh sons of Dewan Singh of Mohalla Kama Khan Poonch and on this information he went to Hospital Poonch and on reaching at the casualty at about 11.15 PM, he saw Balraj Singh alias Foji S/O Dewan had caught his brother Ranjit Singh, and Gojinder Singh alias Jandoo S/O Dewan had caught his brother by his hair and Ravinder Singh s/o Dewan who was holding a weapon of iron kirpan(knife) in his hand gave a blow of kirpan on the chest of his brother Ranjit Singh on its left side, Sukhchain Singh alias Sunti S/O Dewan Singh armed with iron rod also inflicted injuries to his brother Ranjit Singh with iron rod and on receiving the Kirch (knife) injury, his brother died on the spot and after the killing of his brother the accused persons attacked his another brother Ranjit Singh and sister Rajinder Kour ,with the same weapons to kill them and injured them seriously and the accused also tried to attacked on him ,with intention to kill him but he fled away from the spot to save his life.
Principal Sessions Judge Poonch Kishore Kumar after hearing Public Prosecutor Nazir Hussain for the state and Adv Taj Hussain Shah for the accused persons ruled It is a settled proposition that in awarding sentence in our civilised society, a reasonable proportion has to be maintained by the Court between the heinousness of the crime and the punishment.
The sentences are imposed to reflect the seriousness of the crime, to promote respect for the law, to provide just punishment for the offence, to afford adequate deterrent to criminal conduct and to protect the community from further similar conduct. In awarding sentence the court must look into the crime, the victim besides the circumstances of the criminal and the impact of the crime on community and Accordingly, accused persons namely Balraj Singh, Sukhchain Singh and Gojinder Singh Sons of Dewan Singh R/O Mohalla Kamakhan, Ward No. 7, Poonch are sentenced to undergo rigorous imprisonment for life and a fine of Rs.20000/- each, for the offence u/s 302 and 34 RPC. In default of payment of fine, the accused shall further undergo simple imprisonment for six months. Whereas accused Ravinder Singh S/O Dewan Singh R/O Mohalla Kamakhan, Ward No. 7, Poonch is sentenced to undergo rigorous imprisonment for life U/S 302/34 RPC and 3 years for the commission of offence U/S 4/25 I.A.Act. He is also sentenced to pay a fine of Rs. 20,000/-. On the failure to deposit the said amount, he shall further undergo simple imprisonment for 6 months.
