| ‘Dead’ petition benefits Bukhari, Renzoo | | Govt re-fixes their seniority as petitioner retires | | Early Times Report Jammu, Dec31; The state government has effected re-fixation of seniority in favor of two KAS officers in a bizarre manner on the pretext of implementing the court directions. However, the fact remains that the state could not pursue the case in higher judicial forum to contest the claim of the officers which has led to cadre mismanagement in the combined administrative services. Two senior KAS officers M A Bukhari and Farooq Ahmad Renzoo got an interim order from the High Court on a petition filed by Nazir Ahmad Sheikh in 2008 and the government implemented the order the other day effecting re-fixation of seniority of Bukhari and Renzoo while the real petitioner could not get any relief from the order for he has retired from the services few years back. Pertinently Bukhari and Renzoo were figuring quite below and many KAS officers were at the top of the list. Even more important is the point that Bukhari originally belongs to the Employment Cadre-which until recent past was not a feeding cadre for the KAS as was not the Information cadre. Bukhari before moving to the Civil Secretariat has served as District Employment Officer at different places. Latter on as deputy Secretary GAD, Bukhari being privy to the service matters managed re-fixation of his seniority, otherwise he was figuring below Farooq Ahmad Shah ( presently posted as DC Anantnag) and others in the seniority list and even below the 1984 batch of the combined services officers. The employment services as said was not a feeding service to the KAS originally but was included subsequently. There was a difference of grade of a group of services like Under Secretaries to the government, Tehsildars and Excise and Taxation Officers who carried a slightly higher scale than the officers belonging to employment and Information services. In the year 1985 this anomaly was removed and the grades were made uniform retrospectively from 1983. This was, however, only to bring officers of different services on a uniform scale in their initial gazetted services. But again the powers that gave effect to this uniformity of grades retrospectively from 1983 which again led to cadre mismanagement and further litigation. It would have been in the fitness of thongs had government given effect to it prospectively. Though the government initially resisted but finally it even did not file the objections in case of Bukhari which culminated in re-fixation of his seniority without going into the merits of the case. |
