Court awards life imprisonment to one for killing brother & Bhabii

Jammu, Jan 10 (JNF): Principal Sessions Judge Udhampur AK Koul today awarded life imprisonment to Mohd Ashraf alias Bittu S/O Mohd Shafi Caste Chandel R/O Londana, Tehsil Udhampur for killing his brother and Bhabi over a family dispute.
According to the police on September 17, 2008 information was received from reliable sources in police station Udhampur that around 4.15 a.m, accused had shot dead Mohd Aslam alias Bira and his wife Shakila Begum (hereinafter referred to as deceased). Case FIR NO.227/08 u/s 302 RPC read with section 3/25 Arms Act was registered and after conclusion of detailed investigation it came to the fore that accused was not enjoying good relationship with the deceased brother and his wife.
They had a dispute over the family property and the accused believed that his deceased brother had occupied a lion's share of the family property which had given rise to a feud between them. It was also found that accused had got a case bearing FIR No.113/01 registered against the deceased which also increased the tension between the two families and the accused planned to kill the deceased. On the fateful day the accused armed with a gun laid an ambush on the way leading to a water source. He believed that his brother deceased Mohd Aslam was going to water source every day at 4 a.m and he (accused) wanted to seize an opportunity to kill the deceased on his way to water source. The deceased reached there alongwith his brother-in-law Rayaz Ahmed at about 4.15 a.m. The accused shot him and the bullet hit the hand of the deceased Mohd Aslam. The pot and the torch he was having fell on spot and deceased fled away. He reached the house of PW Bashir Ahmed. Accused chased him and fired another bullet on him which hit the deceased Mohd Aslam who fell down on the balcony of the house of PW Basher Ahmed. PW Rani Begum W/O Basher Ahmed on seeing all this raised an alarm when the daughter Rukhsana Akhtar and wife Shakila Begum of deceased Mohd Aslam came running on spot. The accused shot the wife of deceased from behind. She continued to run fast but the accused fired another bullet on her and thereafter a third one also from behind. She also fell down and died. So accused committed two murders in quick succession. Principal Sessions Judge Udhampur AK Koul after hearing Public Prosecutor Navneet Gupta for the state and Adv Ch. Mohd Shafi for the accused persons observed that prosecution has proved its case and awarded imprisonment for life and a fine of Rs.10,000/- u/s 302 RPC and further ordered that the sentence imposed on accused shall remain in abeyance till it is confirmed by the High Court.
