| Court directed SHO P/S Kishtwar to investigate the matter | | Complaint filed against MOS Home | |
Jammu: In a complaint filed by Riaz Ahmed Choudhary a Senior KAS Officer and is presently posted as CEO, Kishtwar Development Authority, Kishtwar against Sajjad Ahmed Kichloo Presently Minister of State for Home J&K, seeking direction to the SHO Police Station, Kishtwar to register an FIR against Sajjad Ahmed Kichloo MOS Home J&K and others under Sections 186, 323, 341 and 506 RPC.
Chief Judicial Magistrate Ajay Kumar Gupta after hearing Adv Zulker Nain Sheikh appearing for the complainant, referred the complaint to SHO Police Station Kishtwar u/s 156 (3) CrPC for investigate the matter in detail and furnish the report before this Court on or before May 14, 2013.
In the complaint it has been submitted that on April 18, 2013 Chief Minister of the State was to visit Kishtwar in order to lay foundation of Kishtwar Campus of Jammu University and there was also one programme at TRC Kishtwar for which the complainant was making the arrangements on the directions of the District Development Commissioner, Kishtwar. on the same day at 10:00 AM the Sajjad Ahmed Kichloo who is local MLA also in addition to Minister of State for Home reached TRC Kishtwar alongwith District Development Commissioner, Kishtwar, Additional Deputy Commissioner, Kishtwar, Superintendent of Police, Kishtwar and other officers of the District Administration. At that point of time the complainant was busy in making arrangements for the function of the Chief Minister alongwith his officials posted in KDA. The moment of the complainant reached in the conference hall of TRC Kishtwar the accused shouted at the complainant and said “Aap Apne Ko Kya Samajte Ho” twice and then slapped in full public view twice and when he again tried to slapped third time the complainant resisted at that time and upon this the accused started shouting “arrest him” and all the people surrounding him tried to thrash the complainant and the staff of the complainant rescued him. It is apt to point out here that apart from slapping the complainant the accused deterred the complainant from discharging his lawful duties and also resorted to wrongful restraint and further extended threats in full public view.
In view of the aforesaid criminal act of the MOS Home, the complainant immediately vide his No.CEO/KDA/13/857-63 dated 18-04-2013 lodged a written complaint before the Station House Officer, Police Station, Kishtwar with copies to Senior functionaries of the State Government. The said complaint was properly delivered by the office peon against proper receipt. despite the receipt of the complaint the SHO, Police Station, Kishtwar did not register the FIR as the MLA is a high profile person being Minister of State for Home otherwise there was no reason for the local police to act in the manner by registering an FIR against the accused and other persons who also assaulted the complainant.
It is, therefore, most respectfully prayed that keeping in view the submissions made hereinabove and those to be urged at the time of hearing, the Court may very kindly be pleased to allow the instant complaint by directing the Station House Officer, Police Station, Kishtwar in terms of Section 156(3) Cr.P.C to register an FIR against the Sajjad Ahmed Kichloo MOS Home under Sections 186, 323, 341 and 506 RPC in the interest of justice.
