| HC directed State respondents to defer examination date of Para Medical Students | | | Jammu: Justice Tashi Rabstan of J&K High Court Jammu Wing today in two petitions filed by Jeewan Joyti and Ors and Mohd Tariq & ors after hearing Sr. Adv KS Johal and Adv Ankush Manhas appearing for the petitions, issued notice to State & ors and ordered that in the meanwhile subject to objections from the other side and till next date, respondents are directed to defer the State Medical Faculty Examination for the Session April-May, 2013 scheduled to be held in terms of date sheet. According to the petitioners that the High Court Vide order dated April 23, 2013 passed the following directions “In view of the relief sought for in these applications, the same are disposed of with a direction to the official respondents to declare the result of students of the petitioner’s institutes for Part-I course and entertain the Examination forms for Part-II course and to permit the students of the petitioners institutes to take the examination. Entertainment of examination forms and consequent result of the examination for the course will remain subject to the eligibility and dependent on the result of the part-I examination as also outcome of the main petitions. Further more, it shall be solely at the risk and responsibility of the students.” Justice Tashi Rabstan observed that it appears that aforesaid order was passed in presence of counsel for the respondents whereas the counsels appearing for the petitioners submitted that respondents 2 and 3 have issued Date Sheet (Annexure-D) for J&K, State Medical Faculty Examination, Sessions April-May, 2013 whereby dates for conducting Examination of all the eligible Para Medical Trainees of AMT/ANMT Schools/Private Para Medical Institutes of J&K, State Medical Faculty have been notified. It is contended that official respondents are not allowing the petitioners to participate in Part-II Course Examination despite aforesaid order dated 23.04.2013 passed by this Court. It is also contended that in case official respondents are allowed to go according the scheduled fixed in the date sheet for Examinations of Part-II Course commencing w.e.f. 29.04.2013 and the petitioners are not allowed to appear in the Examinations, the petitioners would miss the bus with a serious consequence of suffering in future prospectus apart from continue remaining in the Institutes at the huge expenses of their parents.
