| Court acquits two women facing trial in NDPS Act | | | early times report Jammu, Jan 7 (JNF): Principal Sessions Judge Jammu Kartar Singh has acquitted Usha Rani W/o Baljinder R/o Talwandi District Ludhiania (Punjab) and Rani W/o Sat Paul R/o Maggu Patti Tehsil and District Hoshiarpur who were facing trial in smuggling of Bhuki as no prosecution witness has supported the charges. According to the police case, on 17.11.2009, they were found traveling in a vehicle No. 1310-JK-14B which was coming from Udhampur to Jammu when it was stopped for routine checking and from the personal search of the accused Usha Rani, Bhuki weighing 6 kg was recovered whereas; Bhuki weighing 7 kg was recovered from accused Rani. The police registered the case against the accused and after investigation submitted the final report in this court. On 12.12.2011, the accused moved an application for confessing their guilt and their statements were also recorded in support of it in which they have admitted all the allegations made against them in the challan. However, the then learned Presiding Officer did not feel satisfied with the confession of the accused, directed the prosecution to lead evidence. Since the prosecution was afforded number of opportunities but not even a single witness has been examined and ultimately vide order dated 23.7.2013, the prosecution evidence was closed. After hearing both the sides, Principal Sessions Judge Jammu Kartar Singh observed that there is no incriminating evidence worth the name against the accused except their confessions which cannot be relied upon in order the convict the accused for such a heinous offence. They were acquitted of all the prosecution allegations for want of evidence. |
