| Court extends judicial custody of 6 students, reserves orders on bail | | BOPEE scam | | S Sabaqat Srinagar, Jan 20: A special anti-corruption court here today extended judicial custody of six students who have fraudulently qualified the Common Entrance Test in 2012. The six students were produced by Crime Branch before the Special Judge Anti-Corruption Kashmir, Mohan Lal Manhas who extended their stay at Central Jail here till January 28. Earlier, the court reserved orders on the bail plea moved by the beneficiary students following the objections by Crime Branch, investigating the case. The court announced to declare its order on January 27. In its objections, the Crime Branch has said that the evidence brought on record prima facie established that they participated in a conspiracy and fraudulently obtained the question paper of the CET prior to the conduct of examination. "The plea taken by the accused applicants that there is no evidence against them is baseless and not based on actual facts," the Crime Branch said. It said that the accused are involved in a "heinous offence" which is non-bailable in nature as such cannot claim bail as a matter of right. "In case the accused are granted bail there is every likelihood of tempering of prosecution evidence and they will try to win over the prosecution witnesses," Crime Branch said, adding, "That the accused are involved in a an offence which has been committed by the accused against the public at large." The six students whose custody has been extended include Ahmad Faraz of Naibasti, Mushtaq Ahmad Lone of Samthan Bijbhera, Naveed Ahmad Bhat of Murhama Bijbhera, Khursheed Ahmad Dar of Chinigund Bijbhera, Yasir Yousuf Hajam of Chandan Pajjan Bijbhera and Yasir Yousuf Dar of Pazalpora Bijbhera. The Crime Branch has named 12 students and nine parents in the charge sheet. Among the students, three are minors and as per counsel CPO of Crime Branch, they will be produced separately before the competent court. The three students and the three remain parents will be produced before the court on January 28 when the main case has been listed , the CPO said. Meanwhile, the crime branch, as per last court orders, is to file objections to the bail applications by former BOPEE chairman Mushtaq Ahmad Peer and another accused Sajjad Ahmad Bhat. Peer, who was arrested on November 23 for allegedly selling of CET papers in 2012, has been chargeshteed along with 24 other persons in case FIR 24/2013 Under Section 420, 120B RPC, 5(2)d r/w (5(2) PC Act of Police Station Crime Branch. |
