| HC stays suspension of BMO Warwan | | | Jammu, Jan 22 (JNF): In a much controversial accident case in Warwan area of District Kishtwar in which one Doctor was terminated and Incharge Block Medical Officer (BMO) was suspended by the Deputy Commissioner Kishtwar, Vacation Judge of J&K High Court Jammu Wing Justice Janak Raj Kotwal today stayed the said suspension of Dr Mehboob Khan. While staying the suspension of Block Medical Officer Dr Mehboob Khan, Justice Janak Raj Kotwal after hearing Adv Sudershan Sharma appearing for the petitioner whereas AAG Ravinder Sharma appearing for the state observed that record reveals that the respondent Deputy Commissioner Kishtwar vide his order dated December 22, 2013 has placed under suspension the petitioner who at the time was posted as Incharge Block Medical Officer, for the reason that when victims of a road accident were taken to PHC Afti for treatment, the staff posted in that PHC, was not available and one of the injured succumbed to the injuries on Dec 21. Suspension order was challenged on the ground that Deputy Commissioner being neither appointing authority nor any authority superior to the appointing authority to pass suspension order, having regard to the grounds on which the suspension has been challenged, the court impugned suspension order shall stayed till next date before the bench. |
