| Court acquits alleged ISI trained militant after prosecution failure | | | Early Times Report
Jammu, Jan 22 (JNF): Principal Sessions Judge Jammu today has acquitted Mohd Hayat Bohru of Chambalwas Banihal District Ramban an alleged ISI trained militant after prosecution had miserably failed to prove its case. Principal Sessions Judge Jammu Kartar Singh after hearing Public Proseuctor Shabir Choudhary, for the state whereas Adv OP Thakur appearing for the accused observed that the prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt. "The investigation is tainted and leads the court nowhere. It has not been proved by the prosecution as to who has conducted investigation in this case and whether the grenades recovered on the disclosure statement of the accused or not. In view of such evidence, the court is left with no alternative but to acquit the Mohd Hayat Bohru S/o Atta Mohd Bohru R/o Chambalwas Banihal District Ramban an alleged ISI trained militant as prosecution miserably failed to prove its case, and he is, therefore, acquitted of the charges framed against him. Court also ordered that seized arms and ammunition shall be deposited in the District Armory, whereas the seized identity cards and mobile phone shall be destroyed but only after the expiry of period of appeal. According to the police case that on 2/12/07, the police party of Police Station Nagrota had laid a naka near TCP Bye Pass Nagrota and about 11 am, a young man driving a car without number tried to run away towards the river Tawi on seeing the police and he was followed and apprehended and from his search a bag was recovered from which one pistol without number, two magazines pistol and 11 live cartridges were recovered. Apart from this police recovered one identity card in the name of Imtiaz Ahmed Sohail and one mobile. On enquiry he disclosed his name Mohd Hayat S/o Atta Mohd R/o Chambalwass Banihal and he told the police that he got the training through ISI in handling of weapon in Pakistan in order to cause militancy activities in the State. Deepak Raina SHO came on the spot after seizing arms and ammunition from the accused, he recorded the statements of the witnesses and the offences u/s 307 RPC read with section 7/25,26/27 Arms Act were found proved against the accused and he submitted the final report in the court. |
