| PAG asks Govt to rectify anomaly in pay fixation, promotion to Principal GMC Jammu | | | Early Times Report srinagar, Mar 26: The Principal Accountant General (PAG)--Audit Jammu and Kashmir has ordered the Commissioner Secretary Health and Medical Education to undertake rectification of wrong pay fixation and promotion accorded to Dr Shashi Gupta, Principal Government Medical College (GMC) Jammu failing which concerned treasury officer shall be asked to regulate further drawal of pay and recover the overpayment disbursed in her favour. Top sources in Auditor General's office said that the wrong pay fixation and promotion accorded to Dr Gupta has been effected in contravention to recommendation made by the Public Service Commission (PSC). Despite repeated reminders to the Commissioner Secretary Health and Medical through various letters, the PAG office has observed that effective date of promotion of Dr Gupta as Assistant Professor 'has been altered from April 23, 1995 to April 23, 1994. In its various letters bearing numbers SS-II/2013-14/931-934 dated November 14, 2013, SS-II2013-14/1066 dated December 27, 2013 the Commissioner was asked to have the error rectified and send compliance report to PAG office, by issuing a corrigendum to the Government order, which has not been done so far.' The PAG had ordered that the wrongful promotion and subsequent promotions based on this unauthorized alteration need to be reversed and overpayment made to her needs to be recovered. In its latest latter issued on February 5, 2014 the Deputy Accountant General (GS&SS) reads: "…the wrongful promotion and subsequent promotions based on this unauthorized alteration need to be reversed and the overpayment made to her needs to be recovered. In case department HME is authorized to ignore PSC recommendations regarding effective date of promotions, specific authorization may be provided to this office. Otherwise, the concerned treasury officer would be directed to take necessary action in terms of financial rules for regulating further drawal of pay and allowances till overpayment are recovered under intimation to this office." Ironically even after receiving various letters from time to time, the health and medical education department is yet to rectify the error and forward a compliance report including service book of Dr Gupta to PAG office. The PAG had earlier conducted an in-depth enquiry into the fraudulent promotions granted to the Principal FMC Jammu and sent the finding of enquiry of the Commissioner vide letter number SS-II/2013-14/931-934 dated November 14, 2013 establishing therein that PSC had cleared Dr Shashi Gupta for promotion as Assistant Professor Gynecology from April 23, 1995 to June 24, 1996 on notional basis and thereafter on regular basis. However, in the promotion order issued by the department of health and medical education the effective date of promotion has been wrongly changed to April 23, 1994, thereby giving her promotion one year earlier than the due date. The PAG later directed the commissioner to issue a corrigendum to the above government order and the pay fixation/promotion with effect from April 23, 1994 may be reviewed and rectified. A top source in PAG (Audit) office said observations conveyed by PSC have prima facie established criminal offenses against the then officials of health and medical education department and Dr Shahsi Gupta under RPC and prevention of Corruption Act. "It is reported that health and medical education department is trying shield those involved and has neither got any case registered in the matter and bring the guilty to book nor cancelled the fraudulent promotion orders," sources in PAG Audit office revealed. Subash Pandey, PAG Jammu and Kashmir while confirming said, "Yes it is true that the Health and Medical Education Department has taken a decision in favour of Dr Shashi Gupta in contravention to the recommendations put forth by PSC. But we had sought clarification from the department whether it is conscious decision or an unintentional mistake which needs to be rectified." The PAG said that the department has failed to respond to its various letters issued to it so far.
