| HC directs State to retain services of VC Lawda for six months | | | Jammu, Mar 27 (JNF): In an application filed in the much publicized Public Interest Litigation concerning world famous Dal Lake seeking extension of Yasin VC LAWDA who is superannuating on March 31, 2014, so that various directions issued by this Court concerning technical project may not go unheeded, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar today issued notice to Advocate General. In response, Advocate General has put in appearance and informed the Court that one Sh. Shafat Noor has been appointed as Vice Chairman, Srinagar Development Authority and he has also been given additional charge of Vice Chairman, Lakes and Waterways Development Authority. However, no regular incumbent has yet been appointed as V.C., LAWDA. It is appropriate to mention that in order dated 22.10.2013 the Srinagar wing of the High Court had made following observations that " It has also been pointed out to this Court that Yasin is likely to complete his term/tenure on 31.03.2014. This requires immediate association of another Officer right at this stage as by the time Mr. Yasin demits his office the Officer shadowing him may have grip over the whole matter. The learned Advocate General states that there are opinion available with the Government either to continue retention of Mr. Yasin or in case he is to demit the office in March 2014, then to select a competent and totally devoted Officers to Lakes and Water Bodies. Let the needful be done within four weeks and the status report be filed before the next date of hearing." Division Bench after hearing Sr. Adv ZA Shah with Adv Vipin Gandotra appearing for the PIL whereas Advocate General MI Qadiri with Advocate GS Thakur appearing for the state observed that Despite the observations made in October, 2013 in the aforesaid para requiring immediate association of another so that he may keep shadowing Mr. Yasin, Vice Chairman, LAWDA and may acquire grip over the whole matter nothing has been done by the non-applicant-respondents. In order to serve the environment and maintain ecology of the Lake by implementing various projects and maintaining the pace of development, we feel that it would be necessary to retain the services of Sh. Yasin. Therefore, we direct the non-applicant-respondents to retain the services of Mr. Yasin, Vice Chairman, and LAWDA at least for a period of six months to start with. The non-applicants may if so advised allow a regularly appointed person to work with him so that he may have all ideas of working of various projects related to Dal Lake. Court further observed that the needful shall be done immediately but in any case before March 31, 2014.
