Jammu, May 13 : Sub Judge Katra Manoj Parihar convicted accused namely Rinku Kumar S/O Dev Raj Caste Ram Dassi R/O H.No. 161/C Hari Nagar Old Janipur, Jammu driver Alto car No.0693/JK02AS for commission of offences U/S 279/337/338/304A R.P.C and awarded three years imprisonment.
Brief facts of the case are that on 22.02.2011 at 12.30 PM information was received through reliable sources that the driver of Alto car bearing No.0693-JK02AS while driving the same in rash and negligent manner from Nomain towards Katra hit one Auto bearing No.5721/JK14 which was going towards Kadmal and caused accident, in said accident a lady namely Sunita Devi who was sitting in said Auto was seriously injured and succumbed to injuries where as one Vicky Kumar and one girl child namely Devi got injured and FIR No.102/2011 U/S 279/337//338/304A RPC was registered in P/S Katra.
After completion of investigation charge sheet was presented in the Court of Sub Judge Katra. Sub judge Katra Manoj Parihar after hearing the counsel for accused Pawan Khajuria and Senior Prosecuting officer R.P Singh along with Prosecuting officer Kishore Sharma observed that the prosecution have proved the offences against any shadow of doubt as Prosecution witnesses examined in Court have supported the prosecution story, as such accused is found guilty U/S 279/337/338/304A RPC and accused is convicted according and sentenced to undergo simple imprisonment of six months under sanction 279 RPC, six month under section 337 RPC, six months under section 338 RPC and three years under section 304-A RPC. |
