Jammu, May 13 : In a much publicized Public Interest Litigation against alleged nexus politicians, police officers, bureaucrats allegedly in connivance with land mafia in various part of J&K for allegedly land-grabbing, A Division Bench of State High Court Comprising Justice Mohammad Yaqoob Mir and Justice Dhiraj Singh Thakur today issued various directions. When the PIL today cam-up for hearing, Division Bench observed that this PIL in fact owes its origin to certain reports as were highlighted in various newspapers wherein allegedly big chunks of land belonging to State have been occupied unauthorizedly by various persons, details of which are reflected in various orders recorded in this petition from time to time. Certain action taken reports filed would suggest that appropriate action as against certain persons occupying big chunks of land have been taken and land has been retrieved. Division Bench further observed that in an application filed by petitioner that 66436 kanals 01 marlas of land, which belong to JDA are situated in different localities of Jammu, have been encroached upon, which encroachment is required to be removed, directed JDA shall respond to this application and submit the action plan, if already prepared by the JDA, and If not already prepared, they shall prepare the same wherein it shall be clearly indicated as to how much land is located in which area and what measures have been taken and what policy has been adopted for ensuring complete removal of the encroachment. In an application filed by one One Ram Krishan r/o Bhagwana Chack Tehsil Hiranagar and District Kathua for intervening in the PIL on the ground that he pointed out certain encroachments regarding the illegal/ unauthorized occupation of 189 kanal and 01 marla of state/ common land bearing khasra no.1020/471,719,671,670,561,564,666, 665, 7 Kanal 5 Marla bearing Khasra no. 25 (Shamshan Ghat), 36 Kanal 8 Marla bearing Khasra no. 244 (Mafide-aam) and 8 Kanal 11 Marla bearing Khasra no. 381 (Pond/Talai), situated at village Bhagwana Chack, Tehsil Hiranagar & District Kathua to the notice of Deputy Commissioner Kathua and Tehsildar Hiranagar but no action has been taken against the powerful encroachers. Division Bench further observed that the Deputy Commissioner was under the command to indicate as to why action in accordance with law could not be taken against those persons, who have encroached upon the State land/common land/Kachharai land and directed that the report was to be filed before the next date, which has not been filed. The requisite report be filed by or before the next date of hearing. |
