| Court acquits rape accused of all charges | | | JAMMU, June 28 (JNF): Presiding Officer Sanjeev Gupta of Fast Track Court has acquitted one Hassan Bhatti who was facing trial in kidnapping and rape case as prosecution miserably failed to prove its case. Presiding Officer Sanjeev Gupta of fast track court after hearing Adv Prince Khanna appearing for accused observed that after taking into consideration entire material on record and in view of the glaring loop holes in the case pointed, it is not possible to believe evidence given by prosecutrix regarding her kidnapping and rape by accused which is not only untrue but also not reliable. It appears that she is consenting party in whole act who eloped accused possibly on account of having affair with him. Court further observed that the facts and the circumstances of the case, it apparent that prosecution has miserably failed to bring home the guilt against the accused and accordingly prosecution case is dismissed and accused is acquitted. According to the police case; on May 7, 2009 father of the prosecutrix approached Police Post Gujjar Nagar Jammu and lodged a report to the effect that about 3/4 days back, prosecutrix had gone to visit the house of her maternal grand-mother situated at Jogi Gate who went missing near Jogigate and despite frantic search with different relatives, no clue of her daughter was found. |
