Jammu, Mar 27: Principal Sessions Judge Jammu Vinod Chatterji Koul today decided one of the oldest murder case and awarded life-imprisonment to Abdul Rashid s/o Sain Mohd, R/O Sura, Tehsil & District Jammu in murder case. According to the police, one Sain Mohd s/o Sahab Din, who is father of the accused stated before the police that accused who is his son from his other wife and was having enmity since long. He killed and injured members of his family out of this enmity. On this statement police registered FIR No: 22/1993 and conducted the investigation.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing Public Prosecutor Rakesh Kumar Badyal for the State whereas Adv Bl Chatha for the accused observed that /s 302 RPC is sentence of death or life imprisonment and fine. Since in the circumstances of the case, as the case does not fall within the category of rarest of rare case, therefore, punishment, sentencing the accused to life imprisonment, would be appropriate sentence, , therefore, sentenced to imprisonment of life and fine of Rs. 20,000/- for offence punishable u/s 302 RPC. In case of his default in payment of fine he shall undergo further imprisonment for a period of 03 months. |
