Revenue Department turns deaf ear to implement court's order, alleges complainant

Jammu, Apr 9: A poor man hailing from Kewal village under Budhal Naibat of Kotranka tehsil in Rajouri district today alleged Revenue authorities of playing foul play in matter related to implementation of court's order regarding a land case dispute depriving him of justice.
The victim, Mohd Amin son of Khushi Mohammad resident of Kewal Budhal claimed to have contested this case for eighteen long years in High Court of Jammu and Kashmir, he said addressing a press conference in Rajouri Press Club today.
Mohd Amin presented a number of papers related to court judgements as well as order issued by district administration Rajouri, which however, hasnot been implemented.
As per Judgement copies, High Court of Jammu and Kashmir issued a judgement in LPAOW No. 60/2009 after which Office of Deputy Commissioner Rajouri vide office letter No DCR/SQ/ 3502-03 Dated 08/03/2018 directed Additional Deputy Commissioner Koteranka for implementation of court order and to hand over the possession of land measuring 12 kanals and 17 maral's bearing Khasra No 873 at village Kewal to Mohd Amin son of Khushi Mohd.
"ADC Koteranka directed Tehsildar Koteranka for implementation of order who further issued directions to Naib Tehsildar Budhal and 29th March was finalised as the day for implementation of order " man said while presenting all the order. He further divulged that on 29th of March no officer came on the spot for implementation of order while on 30th of March, Tehsildar Koteranka issued another order to Naib Tehsildar and asked him to submit report in this matter instead of implementation of order.
"Tehsildar Koteranka also mentioned Naib Tehsildar to submit factual report for appraisal to higher authorities and also ordered that eviction be kept in abeyance", he further said. Aggrieved man asked Revenue authorities to divulge reasons for which Tehsildar ranked officer kept in abeyance the order of High Court of Jammu and Kashmir.
"Is Tehsildar really above J&K Special Tribunal of High Court and Double Bench of High Court ?" he questioned further requesting Deputy Commissioner Rajouri to clear which higher authorities directed Tehsildar Koteranka to kept in abeyance the court order and not to implement court order. "I have been threatened for life and forced to step back and is this the justice delivery system where a poor man, who contested case for 18 years, and court also issued judgement in favour for five times, has to struggle for justice on ground" he further questioned.
The said man also narrated that for 18 years, he contested case in High Court after collecting money from relatives and than from people in Temples, Gurudwaras and Mosques in Jammu and the clothes which I am wearing were donated by an advocate of High Court. "If this time also, authorities fail to deliver justice, I wish to die than" he further stated in press conference with tears in eyes. Meanwhile, DDC Rajouri, Dr. Shahid Iqbal assured to inquire the matter on priority. "If any of our officer will be found guilty, stern action will be taken", said DDC Rajouri.
