HC dismisses appeal of Presentation Convent, imposes Rs 20,000/- fine

Jammu, Oct 2: The Division Bench of Jammu and Kashmir High Court headed by Chief Justice Gita Mittal and Justice DS Thakur has dismissed an appeal filed by the management of Presentation Convent School Gandhi Nagar and imposed a penalty of Rs. 20,000 to be paid to the respondent within two weeks.
The case involved denial of admission by Presentation Convent School in the year 2014 to its own student Anandita Jandyal Mehta D/o Sudershan Mehta R/o Tange Wali Gali Kachi Chawni, in the Medical stream. She was forced to appear in Class 11th and 12th in JKBOSE affiliated school.
Her family had initially approached lower courts in the year 2014 and later on the Jammu and Kashmir High Court as well as J&K State Commission for Consumers, seeking damages.
The appeal of Presentation Convent School was dismissed by the Division Bench of Chief Justice Gita Mittal and Justice DS Thakur on29/9/2018, directing the Convent School to pay Rs. 20,000 to Anandita Jandyal. Advocate Parveen Kapahi was learned counsel of Anandita Jandyal while DR Khajuria for Presentation Convent School.
Pertinently, Ananditya Jandyal had taken examination of matriculation in the month of March 2014 in Presentation Convent School but in the first week of April 2014, the School Management had furnished lists of students giving grades as per their sweet will besides giving them streams (Medical, Non-Medical, Commerce, Arts), even before announcement of results", they have mentioned.
Anandita Jandyal was asked to join classes of Commerce subject but she refused as she was willing to go for Medical stream. The result was declared on 20th of May and Anandita got A2 grade but surprisingly 15 students got A2 grade and were given stream of their choice except Anandita, who was denied the entry, on the excuse of not joining the classes.
