| Pre-arrest bail in attempt to murder case rejected | | | Early Times Report
JAMMU, Dec 6: 2nd Additional Sessions Judge Jammu Virender Singh Bhou today rejected the bail applications of Farhan Kohli and Zohaib Sadiq allegedly involved in attempt to murder case in Gandinagar.
According to the police case that that on 11.11.2018 The accused had an altercation with the complainants following which the accused fired upon them. The incidence is clear and evident in CCTV footage of Diva showroom and is lying with the police authorities. The complainant immediately lodged a complaint against the accused persons in PS Gandhi Nagar whereupon FIR was registered against accused persons and accused Asim Ghai was arrested whereas the other two accused who are applicants herein this application are still absconding and evading arrest whereas accused Asim Ghai has been admitted to bail by the Court of Learned Special Municipal Magistrate, Jammu. CD file further indicates that only FSL report regarding use of weapon of offence is to be procured from FSL and the investigation in the case is in progress.
2nd Additional Sessions Judge Jammu Virender Singh Bhou after hearing both the sides observed that and as per police report are categorical and pin points the involvement of accused for the commission of such offences notwithstanding the fact that investigation is in progress and FSL report regarding use of weapon of offence is to be procured but given the conduct of the applicants-accused that they have never appeared before the police nor cooperated with the police and are absconding and there is every possibility that in case of their admission on bail they would try to pressurize and win over the prosecution witnesses and they may jump over the bail as well. With these observations Court rejected the pre-arrest bail of accused persons. |
