Illegal transfers hamper work in Govt Deptts

srinagar, Dec 6: In violation of the rules, various government departments have been making illegal transfers, which affect the functioning of the governance.
For the last few months, several government departments have made transfers without any knowledge from the competent authorities.
Take for instance, Financial Commissioner Revenue has written to Divisional Commissioners of both regions that some Patwaris appointed against the district cadre post have been transferred/attached in other districts.
"It has been observed that Patwaris who have been appointed in rural districts/home districts have been transferred outside the district and are presently serving in other districts, which is violation of the rules and the work in districts where from the patwaris have been transferred also suffers," the letter reads.
Similarly, the concerned authorities have been directed by the government that each transfer proposal shall be processed in accordance with the provisions of the Jammu and Kashmir Business Rules and Transfer policy notified vide government order No 261 GAD.
"It is accordingly, enjoined upon all officers HoDs working under the control of the Revenue Department to ensure that no transfer/posting of any officer/official is effected without the approval of the competent authority," another order reads.
The Agriculture Department has cancelled several orders, which were issued "without competent" authorities.
"It is hereby ordered that the government orders, issued/administrative approval conveyed to various directorates of agriculture production department concerning transfers elevations are hereby rescinded as the same have been issued without the approval of the competent authority," an order issued by Secretary Agriculture Production says.
The Secretary Agriculture Production has cancelled at least 10 transfer orders issued during the month of July and August.
Deputy Secretary Revenue Department has written to Financial Commissioner Revenue, Divisional Commissioners, and Deputy Commissioners that "every transfer shall be processed in accordance with the provisions of the Jammu and Kashmir Government business rules and Transfer Policy".
"Further all proposals relating to powers of transfer, which are presently delegated in the transfer policy at item No I,II, III, IV, and V shall be submitted to Administration Department for decision. It is accordingly, enjoined upon all officers HoDs working under the control of the Revenue Department to ensure that no transfer posting of any officer/ official is affected without the approval of the competent authority," the order says.
The order further reads, "In case any transfer posting has been made after issuance of the said SRO by any officer/authority without approval of the administrative department, the same be furnished to this department for regularization with full justification failing which the concerned officer having effected such transfer/posting shall be personally responsible for action as warranted under rules for willfully floating the government statutory orders."
Similarly, the General Administration Department has written to Advisors to Governor that every transfer proposal shall be processed in accordance with the provisions of the Jammu and Kashmir Government Business Rules and Transfer Policy.
"Further all proposals relating to powers of transfers shall be submitted to Administrative Department for decision by orders of the Governor," the communiqué reads.
As per the Transfer Policy minimum tenure of a government employee on a post should be two years and a maximum of three years. The policy says that premature transfers shall be made only in unavoidable circumstances.
The GAD has also said that some administrative secretaries "have or are issuing transfer and posting orders of officers and officials at their own level without the approval of the competent authority".
"This act on the part of such administrative secretaries is not only unbecoming of a senior government functionary but also a stark violation of the provisions," the order reads.
