SIC seeks attendance details from KU

srinagar, Dec 15: State Information Commission (SIC) has directed the authorities of Kashmir University (KU) to provide attendance details of a candidate alleged to be a government employee who is reportedly pursuing Integrated MBA (IMBA) course in the university as a regular candidate.
Details available with Early Times reveal that one Bilal Ahmad Bhat a resident of Pulwama sought information from PIO, University of Kashmir, Srinagar regarding detailed attendance report of Bariq Manzoor of IMBA Batch 2014 Enrollment No 14037111003 from 2014 till the date of filing of his RTI application. Bilal also sought his examination details of semesters till 2018.
In response to RTI application filed by Bilal Ahmad Bhat, the PIO informed him vide his communication dated 07-04-2018 that the information sought does not fall under the ambit of J&K Right to Information Act, 2009 as the same was 3rd party information and the disclosure of the information was likely to jeopardize the interests of the third party, who being a lady has objected to the disclosure of information.
Aggrieved by the PIOs response, the Bilal Ahmad Bhat filed first appeal on 27-06-2018 praying for a direction to the PIO to furnish information to the appellant as sought by him.
The appeal came up for hearing before SIC on 24-10-2018. In view of objections and also in absence of any public interest in the disclosure of information related to the third party, the request for information filed by the appellant on 15-03-2018 was rejected by SIC on 07-04-2018.
Appellant Bilal Ahmad submitted before Commission that the PIO was denying information to him as Barieq Manzoor was being shown present at two different places at the same time. He submitted that on the one hand, she is pursuing IMBA course in the University where 75% of attendance is mandatory for appearing in the examination, while on the other hand, she is shown to be present in the Directorate of State Gazetteers Department, Old Secretariat Srinagar where she is working as class IV employee.
SIC disposed of th on 27.11.218 with a direction to the application directing PIO, University of Kashmir to provide information to the appellant in the form semester-wise aggregate attendance of Barieq Manzoor, Enrollment No. 14037111003 IMBA course Batch 2014 and also the information whether she possessed the necessary percentage of attendance as required for appearance in the examination, without disclosing date-wise details of attendance by the third party.
