SIC dismisses appeal against BDO Assar

Jammu, Jan 15: It has become a norm for some so called RTI activists to file RTI application, then go for an appeal against Public Information Officer (PIO) and then not follow the case before State Information Commission (SIC). Their sole motto is to harass and pressurize Govt officers.
Recently State Information Commission (SIC) dismissed an appeal filed by a person from Doda who neither responded to PIO's reply sent on his email , nor came for inspection of documents to the PIOs office (BDO Assar) nor did he attend the case hearing before State Information Commission (SIC). Information Commissioner feeling agitated finally dismissed his 2nd appeal. The Commission in its order observed that information seeker seems to be not interested in getting information by way of inspection of records and thus dismissed the appeal.
Details available with Early Times reveal that one Haq Nawaz Nehru R/O Doda on 08.03.2018 filed an RTI application before PIO / BDO Assar district Doda seeking information regarding various schemes executed in said Block from 2015 till the date of filing of the RTI application.
Proceedings before the Commission:
The appeal came up for hearing before the Commission on 18.12.2018. The appellant did not attend the hearing. The PIO Daljeet Singh BDO, Assar was present during the hearing. The PIO filed a written statement dated: 25.10.2018 submitting therein that the RTI application dated: 08.03.2018 was received by his office on 15.03.2018. Since the information sought by the appellant was not only voluminous but was also unspecific, therefore, vide communication dated: 11.04.2018, the appellant was told by BDO (PIO) to visit his office on any working day for having inspection of records and also for specifying the particular record required by him, however, the appellant (Haq Nawaz Nehru) never turn up for such inspection.
BDO told Commission that said communication was emailed to the appellant on his two email addresses [email protected] and [email protected] on 24.12.2018 but the appellant Haq Nawaz Nehru did not respond nor attended the office of the PIO for availing the opportunity of inspection of records.
"Since the appellant seems to be not interested in getting information by way of inspection of records, the appeal filed by the appellant cannot be allowed. The appeal is accordingly disposed of without any order or direction " reads SIC order dated 9.1.2019.
