CS seeks review of contempt petitions against Government departments

srinagar, Feb 4: The government departments are not responding to petitions pending in courts in Jammu and Kashmir with authorities not taking any action against officials or counsels responsible for this lackadaisical approach.
An official of Law Department said that government departments were not timely acting on directives of the courts.
"The counsels representing government departments are not submitting the response to courts resulting delay in disposal of cases," the official said.
Recently, the Chief Secretary directed administrative secretaries to immediately review the contempt petitions pending against their departments at both wings of Jammu and Srinagar High Court and take a well informed decision in each of these cases in consultation with the Department of Law, Justice and Parliamentary Affairs to ensure compliance with the directions of the High Court.
In a communication to departments, Secretary Law Department said petitions pending in courts are not being "followed and filed" by the departments and counsels representing them before the courts expeditiously.
"This has created a worrying situation in the state. The delay in filing these petitions is viewed very seriously by the courts and more often the cases are dismissed at the delay stage, which state of affairs cannot afford to perpetuate," the communiqué reads.
The Secretary Law has asked the heads of departments to expedite the process for filing of appeals in these cases.
Thousands of petitions are pending in courts as counsels representing government departments are not following petitions creating a "worrying situation" in Jammu and Kashmir, says the Law Department.
There are over 5300 contempt petitions pending against various governments in various courts of the state. Besides, there are other petitions pending before the court of various departments. The state's law department has taken a serious note over lackadaisical approach of counsels representing government departments.
The High Court recently came out with a list, which indicates over 5300 contempt petitions are also pending in two wings of the High Court.
The School Education Department is on the top of the list as a total of 1286 contempt petitions are pending against its authorities for not complying with the directions/ orders passed in different matters.
Majority of these contempt petitions have been filed against the Administrative Secretary of the School Education Department.
Revenue Department is at the second place as a total of 383 contempt petitions are pending against its authorities. Majority of these petitions have been filed against the Collectors of Land Acquisition, Deputy Commissioners and Administrative Secretary of the department. Besides there are hundreds of contempt petitions pending against the Public Health Engineering Department, Power Development Department, Public Works Department, Forest Department, and General Administration Department.
