Traffic PIL: HC orders appearance of Div Com, four other officers if orders not complied

SRINAGAR, Feb 19: High Court has directed the government to file detailed compliance to its directions passed on September 12 last year, and ordered personal appearance of five top officers including Divisional Commiss-ioner Kashmir and Inspector General of Police Traffic Kashmir to appear in person before it on March 19.
"This court, in terms of order dated 12th of September, 2018, has already detailed out the issues involved in the instant Public Interest Litigation and, accordingly, directed the respondents to file compliance in respect thereto. We need not reiterate the said issues any further," a division bench of Justice Ali Mohammad Magrey and Justice Sanjeev Kumar said.
"Let compliance be filed by the respondents within a period of two weeks, failing which the following Officers shall remain present in person before the Court on the next date of hearing (on March 19," the court said.
The officers include Divisional Commissioner, Kashmir; Commissioner, Srinagar Municipal Corporation; Vice Chairman, Srinagar Development Authority; Inspector General of Police, Traffic, Kashmir and Senior Superintendent of Police, Traffic, Srinagar.
"It has been brought to our notice that despite directions passed by this Court from time to time, different vehicles in the shape of Sumos, maxi cabs, mini buses, etc., are parked on the roadside at the Batamaloo Bus Stand," the court observed and asked Divisional Commissioner, Kashmir, to ensure implementation of the directions passed by the Court from time to time, whereby it has put a restraint on parking of any vehicle in and outside the Batamaloo Bus Stand.
"He shall file compliance to that effect before this Court on or before the next date of hearing, without any fail."
Advocate Anil Bhan, the counsel representing the Indian Oil Corporation, submitted that despite directions passed by this Court on September 12, asking the Deputy Commissioner, Srinagar, to submit the compliance, same has not been done as on date.
"B A Dar, the Senior Additional Advocate General, to ensure compliance of order dated 12th of September, 2018, as regards the claim of the Indian Oil Corporation Limited by the Deputy Commissioner, Srinagar," the court added.
On September 12 last year, the high court had issued as many as 10 directions regarding establishing CNG outlets, removing encroachment on pavements in Srinagar; shifting taxi stands/mini bus stands and auto stands from Batamaloo; finding solution to roadside parking problem; addressing issues with regard to traffic congestion on cross roads; removing vendors who cause difficulty to free flow of the vehicular movement as well as the foot movement of the pedestrians at Panthachowk Bus Stand; ensuing facilities at the Parimpora Bus Stand and removing vendors there; proper management of traffic lights and taking strict action against those indulging in honking of horns unnecessarily in city.
Furthermore, the court had directed that vehicles carrying building material should be properly covered with canopy to avoid air pollution as per circular issued by the office of the Divisional Commissioner Kashmir.
