Srinagar, Apr 3: State Information Commission (SIC) has turned down a Right to Information appeal on the plea that information sought by RTI applicant does not fall within the definition of information as per the provisions of J&K RTIAct 2009.
Details available with Early Times reveal that one Mehraj Din Bhat S/O Mohammad Ashan Bhat, a resident of Dhrambal, Takyabal, Sopore on 6.11.2018 had filed an application under JK RTI Act 2009 before the PIO J&K State Board of Technical Education (JKSBOTE). Information seeker an aggrieved job aspirant sought to know from Secretary, J&K State Board of Technical Education, whether 2 years ITI in Motor Mechanic Vehicle is eligible for participating in Transport ; Whether 2 years ITI Motor Mechanic Vehicle carries subjects of Petrol and Diesel or by which subjects ITI in Motor Mechanic Vehicle is to be completed on 12.12.2018;.
Bhat filed subsequent appeals as information was not provided.
The appeal came up for hearing before the Commission, PIO, JKSBOTE submitted that the information sought by the appellant with respect to two courses referred in his RTI application viz. Mechanical Motor Vehicle and Diesel Mechanic are different trades as per the curriculum of National Council of Vocational Training (NCVT). Further, the PIO submitted that the appellant vide communication dated 10.12.2018 was informed that the eligibility of different posts was in accordance with the recruitment rules for each post.
While deciding the appeal SIC observed, "Keeping in view the observations made herein above, the Commission cannot direct the PIO to reply to the quarries raised by the appellant in his RTI application asking the PIO to interpret and deduce conclusion by comparing the two trades and supply the conclusion to him. Such a demand / request does not fall within the definition of "information' as defined in section 2(d) of the J&K RTIAct, 2009. This appeal is accordingly disposed of without any further order or direction".
