HC Seeks report on implementation of SWM rules on ground in Sonamarg

Srinagar, Apr 5: The state high court today directed government to file an affidavit, indicating the implementation of Solid Waste Management (SWM) rules on ground level at Sonamarg tourist resport.
Hearing PIL on conservation and protection of Sonamarg tourist resort, the division bench of the court passed the direction after the amicus curie advocate Nadeem Qadri pointed out that the rules are already existing and the authorities be asked as to what steps have been taken till date to implement them.
Senior additional advocate general B A Dar informed the court that as per the previous directions of the court, the SWM by-laws have been notified while the action plan was ready but those could not be filed on time as the authorities were engaged with upcoming parliamentary elections. the court granted senior AAG two weeks time to place the notified SWM bylaws and action plan before the court on next date hearing in the PIL.
High Court today directed the State Government to inform the court about the implementation of Solid Waste Management rules of 2016 on ground level as also the steps taken for notifying the Solid Waste Management bylaws.
The High Court has directed all the subordinate courts including all tribunals not to pass or entertain any kind of order with regard to construction in Sonamarg.
To save Sonamarg from becoming a concrete jungle, the High Court has already banned till further orders all constructions at the tourist resort in central Kashmir's Ganderbal district.
"We have noticed that constructions are taking place in Sonmarg. We direct that no construction shall be carried till further orders," the court had said.
