Nature must be protected while framing MP for Sonamarg: HC

Srinagar, Dec 31: Jammu and Kashmir High Court has left it open for the government to examine issues relating to completion of Master Plan for Sonamarg meadow, underlining that it wants viable solution and not "paper work without substance not meeting the requirement of protecting the nature of the famous Tourist destination on the Tourism Resort plans."
"The concern of the Court in this PIL is to ensure that the formulation of GIS based Tourism Master Plan for Sonamarg-2040 is finalized with some yielding results. It should not be a paper work without substance not meeting the requirement of protecting the nature of the famous Tourist destination on the Tourism Resort plans," a division bench of the court said while hearing a PIL. "We expect from the Government and the Chief Town Planner, Town Planning Organization, Kashmir, to explore the possibility of extracting available documentation of world reputed agencies involved in the finalization of Tourist destination Master Plan and submit the same after analyzing before the Court on the next date of hearing."
Amicus Curiae, submitted that a lot is required to be done for ensuring effective revision of Master Plan, including associating some experts having knowledge, concept, Plan management of the Tourist destinations in India.
He further submitted that Court may before allowing the government to finalize the tender process for preparation of GIS based Tourism Master Plan for Sonmarg-2040, examine the documentation, presentation of competing parties. "We leave it open to the respondents to examine this issue and come with the viable solution," the court said and posted the matter for further consideration on 16 March 2020. "In the meantime, Amicus Curiae, shall examine the compliance/ status report and file response to the same by or before the next date of hearing," the court said.
Earlier, Fayaz Ahmad, Chief Town Planner, Town Planning Organization, Kashmir and Mushtaq Ahmad, CEO, SDA were present in person and later filed compliance report. He said stated that the evaluation of the technical bids shall be completed by January 6. "Based on the technical evaluation score, financial bids of the qualifying bidders/consultants shall be opened for its evaluation by the committee to be constituted by the Administrative Department (Tourism) and after due process the assignment shall be awarded to the consultant having sound credentials and highest score," the court said.
The court said it examined the details of participating consultants, bidders for formulation of GIS based Tourism Master Plan for Sonmarg-2040 and that there are no details enclosed with the compliance regarding the experience of the bidders quo preparing the Master Plan in the famous Tourist destinations. When asked, Chief Town Planner submitted that the endeavour of the government is to finalize the assignment of the work to the consultant having sound credentials and highest score.
