Court won’t remain mute spectator to traffic mess: High Court

Srinagar, Feb 4: Sending out a tough message, Jammu and Kashmir High Court on Monday said that it will not remain a mute spectator to “traffic mess” and that it would not allow roadside parking in the Kashmir Valley.
Hearing a Public Interest Litigation, a division of Justices Ali Mohammad Magray and Dhiraj Singh Thakur also observed that it would direct Divisional Commissioner Jammu to remove the roadside parking for smooth flow of the traffic in the winter capital of the Union territory.
“Court will not remain as a mute spectator on the issue of traffic mess and will not allow anyone to keep their vehicles at roadside,” the bench observed, underlining that traffic mess creates hardships to common people and makes commuting difficult. “We will also direct Divisional Commissioner Jammu to remove the roadside parking for smooth flow of the traffic in Jammu,” the court observed. A detailed order is likely to be issued by the court in a day or two.
On last date of hearing, the court while again impressing upon the authorities not to allow roadside parking in Srinagar city had also warned government over failure to make parking place availability clause mandatory for registration of the vehicle in the state.
“We again impress upon government to ensure that no vehicle is allowed to be parked on roadside and vehicles shall be parked in designed parking place only,” the division bench had said.
The court on the asking of B A Dar, senior additional advocate general, granted four weeks time for filing compliance of the order dated 18-12-2019 on regulating traffic in the city and ordered that in case of failure, Commissioner Secretary to government transport department shall appear in person on next date of hearing which was today.
The division bench further had also directed Government to come up with a policy of banning the use of roads, be it National Highway, State Highway, City Roads for parking purposes.
