DB directs Secy Revenue for ensuring proper assistance to PDA

JAMMU, Oct 3 (JNF): A Division Bench of J&K High Court comprising Chief Justice Gita Mittal and Justice Puneet Gupta directed Secretary to Government, Revenue Department, Union Territory of Jammu and Kashmir to ensure that the proper assistance is rendered to the Pahalgam Development Authority (PDA).
This significant order has been passed in a petition in which the Pahalgam Development Authority has repeatedly made a grievance that the Revenue Authorities are not cooperating in the matter.
When the petition cam-up for hearing, Division Bench observed that a compliance report dated 21st of September, 2020 has been filed by the Chief Executive Officer, Pahalgam Development Authority, the list of persons-lessees is enclosed. It discloses a terrible state of affairs.
In the compliance report it has been stated that 75 parties are in occupation of 75 plots comprising 79 kanals 8 marls 7 Sirsai and 4 sqft out of which 63 kanals 18 marlas 1 Sirsai and 5 sqft has been leased out by the Government and 15 kanals and 10 marlas and 6 Sirsai are encroached upon by different persons. It is stated by Pahalgam Development Authority that it has no record of any grant of any lease.
It is further stated that the Chief Executive Officer, Pahalgam Development Authority has issued a series of public notices through the print media for the production of lease documents by the lessees.
It appears that none of these persons have come forward. These persons are occupying the public property without any legal right to continue and none of these persons are paying a single penny to the Government even though the property is being used for commercial purposes.
DB observed that no action seems to have been taken by the respondents. It is a serious issue which needs immediate attention of the authorities. Inasmuch as the digitized record is in a very bad condition. This matter is adjourned today. JNF
