Court awards life-imprisonment to two in murder of young boy

SRINAGAR, Feb 15: Principal Sessions Judge Pulwama Abdul Rashid Malik awarded life-improsionment to Sameer Ahmad Sheikh and Javid Ahmad Shah.
The brief facts of the prosecution story are that the complainant Ghulam Ahmad Wani approached SHO P/S Pulwama on 2-4-2011 with a written complaint that his grandson namely Khursheed Ahmad Wani left on March 25, 2011 with accused number 1. The complainant mentioned that he got the information that his grandson has stayed in the house of accused number 2 but despite the passing of five days, he has not returned back.
The complainant stated that his grandson has taken Rs.25,000 from him on account of school fee, with him. The complainant submitted in the complaint that he is worried about his safety and the accused have full knowledge about his whereabouts. Before this as per the police report on April 2, 2011 Police Station Pulwama received an information through reliable source that at village Murran under the heap of cow dung one blood stained dead body is lying who has been killed mercilessly by some unknown person. This information culminated into an FIR under section 302 RPC. The police machinery came into motion .The investigation of the case was taken into hand.
During investigation the complaint as mentioned, hereinabove was also filed by the grandfather of the deceased. Principal Sessions Judge Pulwama while awarding life-impriosnment to both the accused observed that the deceased was a young boy of 18 years of age at the time of his death who was undergoing his studies in B.A 2nd year. The criminal justice system has to address the plight of the victim also. Mere punishment will not satisfy the victim who has suffered as a result of commission of the crime. The deceased was killed so brutally but the real victims are his parents. One cannot assess the shock and trauma caused to her parents, near and dear ones. No amount of compensation can repair the irreparable loss caused. The mother of the deceased has died. His father is alive, who was out of his home on the date of brutal murder of his son at the hands of the accused and asked the Member Secretary, J&K Legal Services Authority, shall release an amount of Rs. 2.00 lacs in favour of the father of the deceased namely Nisar Ahmad Wani R/o. Babahar, Pulwama.
