DB directs SVO to register case against ex-Social welfare officer | | | Early Times Report
Srinagar, Apr 3: Division Bench of Jammu and Kashmir High Court has directed State Vigilance Organisation (SVO) to register case against former executive director State Social Welfare Board for misappropriation of funds meant for shelter home for widows, children and victims of 2005 earthquake. While taking up the PIL, reserved last month, the Division Bench comprising Chief Justice M M Kumar and Hussnain Masoodi directed State Vigilance Organisation (SVO) to register case against former executive director State Social Welfare Board for misappropriation of funds meant for shelter home under the aegis of department. While hearing PIL on unauthorized shifting of the shelter home-Swadhar Shleter Home from Kralpora Kupwara to Chadoora Budgam, the Division Bench directed that an amount of Rs 2.50 lakh diverted by the officer, Dr Gh Mohiuddin, in favour of a lady for purchasing three marlas of land at Chadoora Budgam along with a sum of Rs 50,000 in issuing a bearer cheque instead of A/C payee cheque be deposited with Swadhar Shelter Home Kralpora, Kupwara. Likewise, the Division Bench also directed that a sum of Rs 24,879 paid vide A/C payee cheque on 26/12/2008 be also deposited by him in the account of Swadhar Shelter Home, Kralpora, Kupwara. "Thus, a total sum of Rs.3,24,879/- be deposited with interest at the rate of 9 per cent per annum from the date of their misappropriation till the date of the deposit," the Division Bench said, directing that the needful shall be done within a period of 30 days. Court asked that Police Station Vigilance Organization Kashmir (P/S VOK) shall register a case under the relevant provisions of Jammu and Kashmir Prevention of Corruption Act, 1949 (Samvat 2006) and Ranbir Panel Code on the basis of inquiry report submitted by it. "The investigation shall be entrusted to a senior officer in P/S VOK and the results of investigation placed before the competent court in accordance with law, preferably within three months from the date of receipt of copy of the order," it added. "The respondents including Union of India shall continue to release funds in favour of State Social Welfare Board/Deputy Commissioner, Kupwara, to facilitate smooth running of Swadhar Shelter Home Kupwara," the Division Bench said. "We make it clear that the funds shall be released in accordance with rules on receipt of utilization certificates required under rules and till Swadhar Shelter Home scheme remains operational." Pertinent to mention, the petitioner had pleaded before the court that the then officer illegally shifted the Home due to which 44 inmates were thrown out of by him and only 5 children from Kupwara were accommodated in the Home at Budgam. Earlier on May 30 2011, Court had directed the concerned authorities to restore the shelter at Karnah as promised at the time it was temporarily closed in November 2007. |
