DB issues directions to Divisional Commissioner Jammu
PIL against unplanned excavation in Jammu

Jammu, Apr 3: In response to Public Interest Litigation (PIL) filed in the larger interest of Public of Jammu city, against unplanned digging and frequent traffic jams in Jammu, Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar directed Divisional Commissioner, Jammu to furnish all the details along with relevant documents and also asked counsel for the PIL to file his counter to the updated status report filed by the Divisional Commissioner.
After hearing Sr Adv BS Salathia, Adv Abhinav Sharma and Adv Meenakshi Salathia, Division Bench observed that an updated status report has been filed by the Divisional Commissioner, Jammu in pursuance of order dated 24.03.2014.
"Some of the areas which are still in dark, are the approximate expenditure incurred for preparing the roads for blacktopping by ERA, have not been revealed in the status report as also the nature and quality of work which is undertaken by the ERA before handing over the roads for blacktopping/macadamization, court observed. It also said as various agencies like PWD(R&B), NBCC, Municipal Corporation and other agencies are involved in the work of blacktopping. The thickness of the blacktopping and the approximate age to which it could last as per the stipulations in the contract agreement has also not been highlighted and added the counsel for the PIL however has asserted that the blacktopping which has been done recently, has developed huge holes and pots on the roads causing accidents as the vehicles cannot ply on such roads. Advocate Abhinav Sharma, has shown some photographs to us and has also sought time to file counter to the updated status report as well as the additional information to highlight the quality of work concerning blacktopping and pre-blacktopping preparations. Upon this Division Bench directed Divisional Commissioner, Jammu to furnish all the details along with relevant documents and Counsel for the PIL may also file his counter to the updated status report filed by the Divisional Commissioner. Pertinently a PIL was filed two advocates namely Ashish Sharma and Deepak Singh Balouria against unplanned digging and frequent traffic jams in Jammu saying the agencies responsible for metalling the same were absolutely callous in the discharging duty.
