Rs 50 Crores swindling case

Jammu, Apr 3: In a much publicized Public Interest Litigation regarding cheating of peoples to the tune of Rs 50 Crores by Dutta Finance Pvt Ltd and ors, a Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Muzaffar Hussain today directed Deputy Commissioner Sonepat, Deputy Commissioner Jammu and the Vice Chairman, Jammu Development Authority (JDA) are directed to proceed to attach these properties without any further loss of time.
Attar after hearing Sr. Adv SS Lehar with Adv Meharban Singh, the Division Bench directed Deputy Commissioner Sonepat, Deputy Commissioner Jammu and the Vice Chairman, Jammu Development Authority are directed to proceed to attach these properties without any further loss of time. When the PIL came-up for hearing, Division Bench observed that In pursuance of the directions issued by this Court, Harbans Lal, former District and Sessions Judge has filed the report disclosing movable and immovable properties along with bank accounts belonging to M/s Dutta Finance Company and other family companies.
As per the status report Flat No. B1/803 situated in Village Akbarpur, Barota, Kundli, Sector 65, Sonepat, Haryana is reported to have been purchased by accused Amarjeet Singh from Sanjay Kumar Jain s/o Arihant Kumar Jain for a consideration of Rs 35 Lacs, out of which Rs. 17, 95,865/- had been transferred from the bank account of M/s Dutta Finance Co and is reported to have been sold to Smt Shashi Bala. In the status report plot no. 46 and 390/6 falling under Khasra No. 260 belonging to Gurdeep Singh have been seized. JDA and Tehsildar Jammu have been intimated not to issue any sale/transfer/fard intikhab/ naqal zamabandi in respect of said plots. Other properties identified in the status report include one godown belonging to the accused Harpal Singh in Yard no 6 bearing plot No. 81 under Survey no. 360, land spread of 24 Kanal 19 Marla at Moosa Chak, R S Pura falling under Survey No. 97,98,99,100,101,102 belonging to the accused Gurbachan Singh Dutta, a house under No. 90/11, Nanak Nagar, Jammu belonging to same accused, land measuring 11 Kanal 14 Marla falling under Survey no. 1126/480 situated at Jajhar Kotli Jammu belonging to one Harpal Singh also have been identified and necessary entries got effected in revenue record, so that sale/ purchase of said land could not take place. In the status report it has been submitted that as per the record, the finance company has different bank accounts with a total deposits in all the bank accounts available at present is to the tune of Rs 21,78,464/-.
Division Bench further observed that there are indications available in the report that the properties have been acquired without seeking specific permission of the Court and therefore, they would be subject to jurisdiction of this Court. Upon this Division Bench directed Deputy Commissioner Sonepat (Haryana) is directed to attach the same because it is evident that the property has been purchased by Shri Amarjeet Singh from the bank account of M/S Dutta Finance Company. A copy of the attachment order shall be sent to the Registrar Judicial of this Court for placing the same on record. Meanwhile Division Bench also directed the Deputy Commissioner Jammu and the Vice Chairman, Jammu Development Authority to proceed to attach these properties without any further loss of time and also shall furnish report to the Registrar Judicial of this Court at the earliest. Meantime in respect of the bank accounts, Division Bench directed the Deputy Commissioner and the concerned Managers of J&K Bank Gandhi Nagar, State Bank of India Narwal, Punjab & Sindh Bank Nanak Nagar, J&K Bank SLR and Punjab National Bank to attach the accounts specified in the status report and send the details of each and every account along with the balance amount available therein. The steps for attachment are taken accordingly without any further loss of time.(JNF)
