Jammu, Sept 11: Principal sessions, judge, Jammu, Rakesh Sagar Jain today awarded six years rigorous imprisonment to Ranjit Singh of Sunderpur, R S Pura, who was facing trial for the last more than six years in the smuggling of Narcotics. A fine of Rs 50,000 was also imposed on him. According to the police case against accused Ranjit Singh is that on 13.12.2008, SHO, police station R.S.Pura sent a docket that on 13.12.2008 at Sunderpur, R.S.Pura, he along with police constables was on patrol duty and at 7.30 pm, he saw the accused coming from Musachak, who on seeing the police started to run away. The accused was chased and taken into custody. On his personal search, one black plastic bag containing poppy husk weighing 1 kg 500 grams was recovered. Thereupon FIR No. 181/08 for Offence u/s 8/15 Narcotics Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the "NDPS Act") was registered against the accused and on conclusion of the investigation finding, the accused guilty of offence u/s 8/15 NDPS Act, the present challan was presented against the accused. Accused was charged for offence u/s 8/15 NDPS Act. The judge, after hearing the two sides, held that the prosecution has succeeded in proving that the accused Ranjit Singh was in possession of 1½ kg of poppy husk which the police recovered from the accused. As per entry No.110 of the Notification Specifying Small Quantity and Commercial Quantity issued vide S.O. 1055 (E) dated 19.10.2001 issued in exercise of powers conferred by clause viia of Section 2 of the NDPS Act, the seized from possession of accused Ranjit Singh is 1½ kg which falls between Small quantity and commercial quantity. Thus the prosecution has succeeded in proving its case and guilt of the accused under Section 15(b) of NDPS Act. With these observations, the court awarded six years rigorous imprisonment and fine Rs 50,000 to Ranjit Singh and sent him to District Jail for serving the sentence. (JNF) |
