Jammu, Oct 25 : Principal sessions judge, Jammu, R S Jain today decided a NDPS Act case and acquitted Jeewan Singh who was facing trial in a case of charas smuggling as there was non-observance of the provisions of the NDPS Act by the investigating agency. According to the police case, a police patrol duty on February 24 last stopped the accused near Bhootnath Mandir and during the checking of his bag, recovered 125 balls of charas weighing about 3 kg 300 grams. Accordingly, an FIR was registered against him for offence 8/20/21 of NDPS Act at Nowabad police station. After the completion of investigation, challan was presented in the court of law. The judge, after hearing the two sides, observed that in the present case, the prosecution witnesses contradict each other on material points which make their testimony unreliable and there is non-observance of the provisions of the NDPS Act by the investigating agency. The prosecution has failed to prove the guilt of the accused beyond reasonable doubts by cogent and clear evidence. As such, the accused is acquitted, the judge directed. |
