HC for action against those hampering removal of encroachments | | | Early Times Report SRINAGAR, Dec 18: Jammu and Kashmir High Court has asked authorities to furnish particulars of all encroachers who are hampering operations to remove encroachments along water bodies so that contempt proceedings and penal action was taken against him. "All the concerned authorities are directed to remove the encroachments," said a Division Bench of the court comprising Justices M H Attar and B L Bhat. "Any person, who obstructs such effort, his particulars shall be furnished to the Registry of the Court so that contempt proceedings, besides penal action as prescribed by law, are initiated against him by the concerned statutory authorities," the bench said. The court was hearing a Public Interest Litigation, filed by one Peer Noor-ul-Haq, seeking removal of entrapments along irrigation channel known as Padshahi canal. The directions by the court followed perusal of a status report by Chief Engineer Irrigation and Flood control Kahsmir that demolition was undertaken on December 1 in presence of magistrate alonwith necessary assistance from SMC and police on Devipora Baghati-Shora Malbagh in Srinagar. "In the process, out of 43 encroachments, 20 were removed on the day. However 18 encroachments showed their residence claiming land beneath the respective encroachments their proprietary land," the Chief Engineer said. In order to determine of the land beneath these 18 encroachments, the officer said, the matter has been taken up with the District Development Commissioners of Srinagar and Ganderbal for getting the land demarcated to verify the actual title of disputed land. "It is necessary to mention here that stretches of the canal where from the encroachments have been removed, the necessary widening has been taken-up to restore its original position," the officer said. |
