SIC shows displeasure over vague reply
Directs PIO, FCI to provide information free of cost within 10 days

Jammu, Feb 19 : Jammu and Kashmir State Information Commission (SIC), reacting strongly over the failure of Public Information Officer (PIO), Food Corporation of India (FCI), Jammu branch to provide timely and clear reply to an RTI application filed by this activist has ordered the PIO to provide the requisite information free of cost within 10 days of the issuance of the order. Pertinently this scribe filed an RTI on 31.10.2014 which was received in the receiving section of FCI, Jammu Division, near Bahu Plaza, Jammu on the same day about the number of times tenders invited by FCI for the purchase of Jute bags/Sacs from different private firms/Contractors this year i.e. 2014 beginning January and ending September; Details of advertisement notices in newspapers for these purchases made by FCI and the person allotted these tenders with details of process of allotment; Details of persons/Firms participated in the process of providing jute bags with their bidding cost and the person allotted these tenders with his/her bidding cost; and judicial status of the tendering process. But the PIO didn't reply on time. Later on, this activist filed an appeal before the First Appeal Authority, FCI Jammu on 09.12.2014 which was also overlooked. Following this, the activist filed second appeal before SIC, a litigation for which was fixed on 27-01-2015 where the PIO, FCI appeared in person along with the scribe and submitted that he had already issued/dispatched the information to the information seeker on 28-11-2014 through ordinary post and the same might be the reason that the information was not delivered timely to the information seeker. The information seeker however conceded it to be true that he had received a reply not on 28-11-2014 but after PIO was sent a notice from the Commission and the information provided was also vague and not as per the RTI application. Taking both the statements on record, the Commission directed the PIO/Assistant General Manager FCI, Regional Office Jammu to furnish the revised information to the information seeker free of cost within ten days from the date of receipt of the order issued by the commission.
