Destruction of acquaintance rolls in Tehsil Office Samba

Jammu, July 29: The State Information Commission (SIC) has issued orders for providing information to an applicant under State RTI Act related to alleged destruction of acquaintance rolls in office of the Tehsildar Samba some years back. The said information was earlier denied by Revenue officials which forced the information seeker to knock the doors of SIC Jammu.
Details available with Early Times reveal that one Shakti Singh Samyal, S/o Late Santokh Singh, R/o Village Sangwali (Peshwalion) Tehsil & District: Samba moved an application dated: 27.01.2015 before the PIO/Assistant Commissioner (Revenue), Office of the Deputy Commissioner, Samba under the Jammu & Kashmir Right to Information Act, 2009 wherein he sought the following information:-
1) About vide letter No. DCS/HQA/14-15/259 dated: 14.07.2015, of PIO, AC(R), Samba in reference to RTI application filed on 21.01.2014. The reply is quite incomplete and incorrect as per report of Tehsildar, Samba vide his letter No. OQ/RTI/570 dated: 25.1.2014. Provide the complete information which was not available in ready pro-forma of Tehsil Office Samba in reference to RTI application dated: 21.01.2014.
2) Provide the copy of FIR lodged with the concerned Police Thana in respect of fire incident and acquaintance rolls getting gutted in fire during curfew period in 2008. Provide the copy of FIR and proceedings initiated by the concerned Police and provide the details of acquaintance Rolls which have been during the curfew period of 2008.
3) In case no FIR has been registered with the concerned Police Thanna, can it be presumed that fire broke out and acquaintance Rolls gutted in fire.
4) Provide the copies of acquaintance Rolls which stand in records and which are gutted in fire during the period 1992-93 to 1997-98 and from 2006-07 to 31.09.2011.
Feeling aggrieved of inaction on the part of PIO, the appellant filed first appeal dated: 30.03.2015, before the First Appellate Authority (FAA) IE Deputy Commissioner, Samba. The perusal of the record shows that the first appeal has not been adjudicated and disposed of by the First Appellate Authority and after that the appellant filed 2nd appeal which was received in the office of the State Information Commission (SIC) on 23.06.2015.
The Commission after receiving the 2nd appeal listed the matter for hearing on 08.07.2015 and 24.07.2015. The PIO/Tehsildar, Samba and Assistant Commissioner (Revenue), Samba were present before SIC during case hearing , whereas, the appellant was contacted by the office of the State Information Commission (SIC) telephonically and he apprised the Commission that he has not received the notice of the Commission about the date of hearing. However, he was given an opportunity of being heard on the telephone and present his case accordingly. The PIO as well as Assistant Commissioner (Revenue), Samba apprised the Commission that the information sought by the information seeker was already furnished to him by their predecessors vide office No. DCS/HQA/14-15/259 dated: 14.07.2014 and the present RTI application is on the same subject matter, and as such no further action is required for the disposal of the present RTI application of the information seeker.
SIC order reads as: "The Commission after going through the RTI application of the information seeker is of the considered view that the information sought by the information seeker requires to be answered para-wise and systematically so that all the queries raised in the application are explicitly responded. In view of the aforesaid facts and observations, the PIO/Tehsildar, Samba is hereby directed to furnish the revised information, free of cost, to the information seeker, answering all the queries systematically, within 10 days from the date of receipt of this order under an intimation to the Commission. State Information Commission".
