Srinagar, Sept 30: The state high court has quashed an order by government ordering premature retirement of an engineer in 2012. The petitioner, Khurshid Anwar Shahhad filed the petition seeking quashing of Government order dated 13.2.12 whereby he was given notice that he, having already rendered 22 years of service, shall retire from service with effect from the same date. Shah was Incharge EE in R&B department and on the complaint of one contractor that he was demanding a bribe of Rs. 2000 from him for processing his bill of the contractual works, the VoK is alleged to have laid a trap against him. FIR was registered against him under PC act and challan was produced before anti corruption court. Pursuant to his arrest in connection with above case he was suspended in March 2007. However subsequently he was reinstated on June 2008. "The impugned order dated 13.2.12 is quashed. The respondents are directed to reinstate the petitioner in service within a period of 10 days from today and, thereafter, within three months allow him full wages from the date he was illegally and without there being any material prematurely retired him from service," a single bench of the court comprising Justice Ali Mohammad Magrey said. The petitioner shall be entitled to all consequential service benefits, including increments, seniority, promotional benefit which he would have otherwise earned but for the impugned order, the court said. |
