| U N Security Council should view on Pak-violations for political status of grabbing Gilgit Agency status quo of India's State | | Part- III | | A N Bharadwaj
Pakistan took horrific in
vasion of on the Indian
J&K State and committed bloodshed brutally and encroached upon a part of territory out of the State, which is to be surrendered and is termed a status quo territory, but Pakistan was asked by the U N Security Council to keep it as care tater. Thus it is answerable to the Council for any political and demographic change made in the territory in question. Pakistan has no sovereign rights over it to alter or cede any part of that territory to other foreign power whimsically at the cost of Indian sovereignty without taking into confidence of the Council and India.
Pak presumes in its own dream about encroaching upon Gilgit Agency which it got in loot and plunder cannot be merged in its domain till it gets its sovereign rights. India has legal sovereign and paramount rights over the territory of Gilgit Agency since the time immemorial. All the relevant historical record such as Sands and agreements are lying in the archives of India, State and British, which reveal authentic information about it.
So much so, the British Government had took permission from the His Highness Government of the State Jammu & Kashmir to open its office for its Agent for vigilance and security of the frontier to watch Russian violating activities reaching Afghanistan by subjugation all the hilly States of the terrain, which was granted by the State Government vide its letter dated 26th November 1876.
Accordingly, the Viceroy, British Crown to India vide subjugating Sanads (legal document) appointed its Agent with the approval of the State Government at Gilgit. The State Government had been busy to stabilize its administration of Chitral and Yasin estates. The Ruler of Chitral Aman-ul-Malik made a subjugating offer to enter in the treaty with the State of Jammu & Kashmir Government in July 1877, which was accepted in lieu of the ruler would present for an annual submissive loyal (Nazrana) of Rs 12000/-Srinagar coinage along with 3-horses, 5-hawks and 5-Tozi dogs (honds) to remain always obedient and loyal sincerely endeavor to obey and execute the orders of His Highness. All the territory of the Gilgit Agency had being ruled by the State Durbar and was under its suzerainty. So much so, the successor of these frontier estates had been approved by the State Durbar. According to the Subjugating agreements called Sanads dated 1892.
The annual submissive tribute (present) of 16-tilas 5-mashas gold was presented by the Chief of Hunza estate and similarly the Mir of Nagar estate according to the Sanad (Agreement) dated 1895 used to pay annual tribute of 17-tlas and one masha the State Durbar. As regard the Chital estate, it acknowledged the suzerainty of the State and an integral part of Gilgit Agency, and Punial estate was also under the suzerainty of the State Durbar and its successor Raja Mohd. Akbar Khan had been approved in 1860 by it. The ruler of Punial Abdul Rehman Khan was approved by the State Durbar dated 31st December 1895, and the State Durbar had full control over it, and the revenue was deposited to State Durbar as tribute, besides the revenue of Ishkaman estate also deposited there as a tribute. Apart from it, Chilas estate used to pay yearly tribute to State Dubrar of Rs.3000/-, which carried itself annually for deliverance to the Maharaja of the State.
The Daral and Tangir estates had also acknowledged the suzerainty of the J & K State.
That entire territory was also too acknowledged by the British Government as the domain of Jammu &Kashmir, where every states and estates hoisted the State flag.
The salute and customary honour had been paid on the occasion of birthday of His Highness, Baisakhi, Dussera, and Basant Panchmi. The flag of the State had been flown at official headquarters.
In the light of these historical facts, Pakistan is going to alter the status quo of Indian State territory occupied illegally without any fear of international norms, especially it changed the demographic and geographical Status of that territory by entering in to unwarranted agreements with China to cede some part to it to enjoy political and economical interest at the cost of Indian sovereignty, and despite resenting and objecting the objection of India against the misadventure to be taken by Pak-China for economical corridor on the Indian territory on their own caused by Pakistan in its national parliament in June 2015, that the talk of disputed territory of Gilgit and Baltistan was a worthless , that was a part of Pakistan . It cannot be a part of Pakistan till it holds a title of that territory. The illegal Pak-occupied Indian State territory through aggression which is lying to be surrendered cannot be a Pak-territory in any circumstances till the U N Security Council takes further action. Beyond violations after violations committed with unbridle manner whimsically by Pakistan, it has distorted the whole status quo. So much so, a gigantic project China-Pak Economic Corridor is on anvil which would pass through sovereign Indian status quo territory without taking in view of International law, diplomatic restrictions and bindings as well as norms despite its resentments and objections. That is a challenge to its dignity and prestige. To veil his aggressive criticism, Pak-Finance Minister Ishfaq Dar justified his Government stand through his national senate on 23rd June 2015, in monarch tone that what un-necessary talk was referred time and again, that was a disputed territory, therefore Gilgit and Baltistan was a part of Pakistan along with Azad Kashmir. It was the low-grading mental out-look of Pak-ruling leaders who did not even know that merely uttering a disputed territory, its sovereign status did not change. They have been living in fool of paradise.
Pakistan is not aware that Jammu & Kashmir State is one of integral part of India. The State has acceded to India lawfully which cannot be challenged, vide India Independence Act of 1947, vide proclamation of British Crown Representative to India, made in the chamber of Rulers of British India States in June 1947, at New Delhi, wherein he specified their powers to merge their States either this or that dominion according to their choice. After the partition of British India, the State of Jammu & Kashmir was in Pakistan as the Ruler of the State merged his domain with India, which was not liked new born Pak-rulers headed by Jinnah, under two-nation theory invaded over the State, committed loot and plunder, thousands innocent people were slaughtered mercilessly in the name of jehad, sexual assaults and rapes and spilled river of human blood, eventually grabbed 3/4th part of the State with the use of force.
In the back ground of non-violence, India did not desire to reply in the same manner, but went to straight way to knock the door of the world body U N Security Council to lodge his Pak-attacking complaint with the request to ask Pakistan to stop further bloodshed and surrender the territory encroached upon illegally; resulting in cease fire was imposed to stop Pak aggressive movement and maintain status quo. It vides its resolution ordered to vacate territory occupied illegally within 30-days, but it did not regard.
In the pleading of cross question, when the J&K State case was being contested, Pakistan confessed of its aggression over Indian State by acknowledging its sin to victimize India. In continuation the U N Security Council also admitted Indian sovereignty over the State, therefore Pak-should keep all the facts as ready reference, before any misleading propaganda. It is a question of sovereignty which cannot be abandoned on the threat of having nuclear power as threatened by Pakistan time and again. Apart from it, to retain peace and harmony in South Asia, the U N Security Council bustled to process plebiscite leaving aside the central subject of the representation which was strange for India and Pakistan. However, these two countries were agreed, and Pakistan was asked to make the congenial atmosphere and vacate the territory from the forces and aliens, but Pak-evaded to comply with the instructions and dis regarded the spirit of the resolution. It was reminded and further reminded, but after dilly-dallying tactics it spurned away to implement the spirit of the resolution. With the result of Pak-reluctance, the plebiscite issue was closed once for all. It cannot be reopened now in any circumstances. In the meanwhile, keeping in view of bringing unsound dead plebiscite issue once again rejected long ago by it on the ground by exhuming, the U N O Secretary General declared specifically that the U N resolutions relating to Kashmir issue were now irrelevant and had no weight in the light of Simla agreement as the issue was bilateral. The violence loving Pakistan is busy to convince international community in favour of its gold plated propaganda of State disputed territory by veiling historical facts lunatic ally, and beats its chest on the tune of its drums for plebiscite rejected by it deliberately long ago. In the light of growing serious situation, the U N Security Council may alert to save the situation before going from bad to worst and the status quo territory should not be misused by Pakistan and mode of its surrendering should be declared for peace.
