'Article 370 has nothing to do with Accession'

JAMMU, Mar 13: The divisive, communal, anti-people and anti-democratic Article 370 is once again in the news. Why do Kashmiri opinion-makers want Article 370 to become a permanent feature of the Constitution? Why because, according to them, it was because of Article 370 that the "agrarian reforms" could be introduced and land allotted to the tiller; the people of the state got land "free of cost under Roshni Act of 2002"; educated youth got relief and the people got a say in matters of governance. These are all spurious arguments and they do not hold any ground. They also say that Article 370 is a bridge between the state and India and the state would become independent if Article 370 was abrogated. It's a bogus argument. Jammu and Kashmir is an integral part of India and it shall ever remain so. That's it.
On the other hand, in Jammu, prominent civil society members have opposed and demanded its abrogation forthwith. They have said Article 370 has not only created a high wall between J&K and the country and helped Pakistan and Kashmiri separatists to mislead the international opinion about the political status of the state vis-à-vis India, but also harmed the people's interests, particularly the minorities, which constitute more than 40 per cent of the state's total population.
The critics of Article 370 have also said that there is not a single country in the world which got divided on the basis of religion and added that the Indian political class not only allowed the partition of India on religious ground to create Pakistan but also sowed the seeds of another communal partition of India by adopting Article 370.
"Article 370 is the manifestation of the same thinking that led to the creation of Pakistan in August 1947 and if the Indian political continued to maintain Article 370, it will also lead to separation of Kashmir from India," one of the civil society members asserted on Saturday while speaking in a seminar on "Understanding Article 370. He also quoted verbatim what Maulana Hasrat Mohani, member of the Indian Constituent Assembly, had said in October 1949, when Article 306-A (Article 370) was adopted. Mohani had said: "Grant of special status to Kashmir on the score of religion would enable Kashmir to assume independence".
He also rubbished the view that the state will get separated from India the moment Article 370 was abrogated and said this atrocious Article had nothing to do with the accession issue. While the state acceded to India on October 26, 1947, Article 370 was adopted two years later, he said, adding that none from the state took part in the discussions on Article 370 in the Indian Constituent Assembly. Article 370 was a temporary provision and it could be abrogated anytime by the Union President by exercising powers vested in him by Article 370 itself.
"The President of India enjoys absolute and unbridled executive powers. By exercising these powers, he can abrogate Article 370," he said. He urged the Union President to exercise the powers vested in him and abrogate Article 370 to avert the impending separation of Kashmir from India. He also questioned the irresponsible Indian political leadership and asserted that it is the Indian political class which never considered Jammu and Kashmir an integral part of India, thus creating problems for the nation in the state. Enough is enough, he said, and added that now is the time to act and integrate the state completely into India.
