22 years RI, Rs 30,000 fine to Pak National

Jammu, Oct 22 (JNF): Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal today awarded 22 years RI and fine Rs 30,000 to Pak National Khalid Pervaz alias Javed o Mohd Ali R/o Ikhalaspur, District Narobal, Pakistan who was working as Pak Army Agent. According to the facts complainant a resident of Bari Baramana kept one tenant Javed R/o Ludhiana, who worked in some factory at Bari Baramana as a labourer. On day he kidnapped the son of the land lords following which a missing complaint was lodged.
On the basis of this report, police registered the case and started investigation. Accused was arrested and interceding the investigation the fact emanated that accused had impersonated his name as Javed, whereas his real name was Khalid Parvez, subject of Pakistan and is PAK National and is residents of Ikhalaspur, District Narobal, Pakistan. Accused was taken over by police of Pathankot from Railway personnel who was required to be arrested in two cases in FIR NO.131/06 U/S 420,468,467,471 IPC and in FIR NO.42/06 u/s 3/34,14 F A and 20 Past Port Act. Thereafter, evidence of the witnesses was recorded by Inspector Parvez Ahmed. Child was recovered.
It is further revealed that accused was employee of Pakistan Police as constable in the year 1997 and a case was registered against him u/s 307 and after the commission of offence, accused absconded, thereafter dismissed from service. In the year 2004, accused with the assistance of one Maj Safdar made a fake passport and entered in the Indian Territory through Wagah Boarder in 2005 for seeking information regarding Indian Army.
Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal observed that accused shall suffer rigorous imprisonment for a period of ten years and shall pay a fine of Rs. 10,000/- (ten thousand rupees only) and in default of payment of fine, he shall suffer further rigorous imprisonment for a period one year ; Under Section 368 RPC convict shall suffer rigorous imprisonment for a period of ten years and shall pay a fine of Rs. 10,000/- (ten thousand rupees only) and in default of payment of fine, he shall suffer further rigorous imprisonment for a period two year. Court clarified that all the sentence shall run-concurrently. Court also directed that after the completion of sentences the convict may be sent back to his country.
