Poonch, Oct 30 (JNF) : Principal Sessions Judge Poonch Kishore Kumar today awarded life-imprisonment to Mohd Nayeem Anwar alias Shazad alias Asaf Safder alias Abu Maz S/O Mohd Anwar Bhat R/O Lahore Pakistan a militant out-lawed Lashker-e-Toiba. According to the police case that On July 11, 2003 Mohd Zubair Mirza Inspector In charge Commando group along with the police personnel of Police Station Mendhar was deputed to observe the activities of terrorists and on receiving the information about the presence of terrorists, search operation in Village Banola was launched and during the search operation, the terrorists who on the instructions of Pakistan intelligence ISI , alongwith heavy arms and ammunition, with a motive to strike the vital parts of the state as well as country and to create law and order problems and also to disturb communal harmony among the people by killing the innocent people of the area and also attack on the armed forces. While searching ,the terrorists attacked the patrolling party at Mohalla Pathana .The patrolling party also retaliated and in this encounter one constable Rajesh Kumar No.367/P was injured seriously during the firing and died on spot whereas const. Muzafer Hussain and Mohd Siaf and Suran were also seriously injured during the firing of the terrorists and during the cross firing two civilians were also injured namely Imtiyaz Ahmed and Azad Khan. Principal Sessions Judge Poonch Kishore Kumar after hearing Public Prosecutor Nazir Hussain for the state whereas Adv Anuj Kapoor (amicus-curie) for the accused observed that Keeping in view the age of the accused, imprisonment for life shall be adequate sentence in the present case. Accordingly, accused Mohd Nayeem Anwar alias Shazad alias Asaf Safder alias Abu Maz S/O Mohd Anwar Bhat R/O Lahore Pakistan is sentenced to undergo imprisonment for life and a fine of Rs.20000/- for offence u/s 302 RPC. In default of payment of fine, the accused shall undergo imprisonment for six months. The sentences shall, however, run concurrently. |
