| Accused gets one year imprisonment, fine in Ghordi accident case | | | Early Times Report
RAMNAGAR, Dec 1: Sub Judge Ramnagar, Sandeep Kour today awarded one year rigorous imprisonment and fine of Rs 5000 under section 279, 337,338 and 304-A RPC to driver of the vehicle Subash Kumar after seven years of trial. According to the police case, on 06.2.2005 Ramnagar police received information through reliable source that passenger bus bearing registration number 3089/JKO2K which was rashly , negligently and carelessly driven by one Subash Chander son of Shankar Dass resident of Danal Johnu Ramnagar met with accident near Basakhi Dabbar in Ghordhi Ramnagar in which 35 persons died and 31 were critically injured. A case under section 279/337/304 RPC was registered against the accused and after completion of investigation challan was presented in court. Out of 68 witnesses cited in the challan 48 witnesses were examined by prosecution during the trial. Awarding sentence Sub Judge Sandeep Kour observed that from the material available on record and after going through entire prosecution evidence it was crystal clear that the 35 passengers lost their precious lives and 31 received injuries due to negligence and carelessness on part of accused. As such offence under section 279, 337,338 and 304-A RPC were proved against the accused person and he was awarded one year rigorous imprisonment and fine of rupees 2000 for offence under section 304-A RPC and in default of the payment of fine he shall undergo simple imprisonment of one month. For the offence 338 RPC accused is sentenced to undergo simple imprisonment of for a period of six months and fine of rupees one thousand and in case of default of the payment he shall undergo simple imprisonment of one month and in case of offence under section 337 RPC accused will undergo simple imprisonment of three months .However as per judgement all the sentence will run concurrently. Prosecution officer Raj Kumar appeared for the State however Advocate Mohan Lal Gupta appeared for the accused. |
